Victory for Life: The Family Foundation’s Statement on KY Supreme Court Order Keeping Commonwealth’s Pro-Life Laws in Effect

LEXINGTON, KY –The Kentucky Supreme Court has issued an order that keeps Kentucky’s Human Life Protection Act, also known as the trigger ban on abortion, and Heartbeat Law in effect while the pro-abortion industry’s challenge to the laws continues. The order leaves in place a ruling by the Kentucky Court of Appeals that allowed the pro-life laws to be enforced after Jefferson County Circuit Court Judge Mitch Perry’s activist order had temporarily stopped enforcement of both laws.

“This is another big victory for unborn babies in Kentucky and for the rule of law. As the U.S. Supreme Court made clear in overturning Roe, the issue of regulating abortion belongs to the people and their elected representatives in the General Assembly, not to activist state-level judges. I am grateful that unborn babies will remain protected while the case continues and for the continued pro-life leadership of Attorney General Daniel Cameron and his team.

“The pro-abortion industry’s argument that the Kentucky Constitution somehow secretly contains a right to terminate the life and stop the beating heart of an unborn human being, despite Kentucky’s 100+ year pro-life history, is absolutely absurd. This court challenge is a crystal-clear reminder why Kentuckians must ensure that state-level, pro-abortion judicial activism is forever stopped by passing the “Yes for Life” Constitutional Amendment on November 8,” Walls concluded.

In the order, the Kentucky Supreme Court accepted transfer of the case and set oral arguments for November 15, 2022. Justices Keller and Nickell noted in concurring, “Finally, we note that prior to the oral arguments in this case, the citizens of this Commonwealth will have an opportunity to embrace or reject an amendment to our Constitution bearing directly on many of the issues in the underlying circuit court action. We look forward to that expression of the will of the Commonwealth.”
