KENTUCKY GOVERNOR BESHEAR STAYS ‘AWARE’ OF OUTCOME OF TRIGG CO. SHERIFF AARON ACREE CRIMINAL CASE 

GOVERNOR SAYS HE AND HIS OFFICE ARE LOOKING OVER BOTH DECADES OLD AND VERY RECENT STATE STATUES TO SEE IF THEY CAN  REMOVE THE SHERIFF FROM HIS OFFICE.

DURING HIS DECEMBER 7, 2023 “TEAM KENTUCKY” UPDATE TO THE COMMONWEALTH, KENTUCKY GOVERNOR ANDY BESHEAR WAS ASKED OF HIS OPINION REGARDING THE RECENTLY-SETTLED LITIGATION INVOLVING TRIGG COUNTY SHERIFF AARON ACREE (PICTURED ); WHO ON NOVEMBER 28, 2023, HAD PLEADED GUILTY TO A PAIR OF OFFICIAL MISCONDUCT CHARGES; AND ALSO TO A PAIR OF MENACING CHARGES.

The governor of Kentucky last week at his regular press conference said he and his office have been keeping aware of the controversial outcome of a southern Kentucky sheriff who has recently pleaded guilty to misconduct charges.

On Thursday afternoon, December 7, during his “Team Kentucky” update to the Commonwealth, Governor Andy Beshear was asked of his opinion regarding the recently settled litigation involving Trigg County Sheriff Aaron Acree, who on Tuesday, November 28, pleaded guilty to a pair of official misconduct charges surrounding Crystal Smith and Lake Barkley State Resort Park, and to a pair of menacing charges involving Smith.

In the plea agreement developed by special prosecutors, third-degree terroristic threatening and fourth-degree assault became menacing, and all four charges are classified as misdemeanors by Kentucky Statute.

Sheriff Aaron Acree was sentenced to one year in jail conditionally discharged for two years, meaning he will be on probation for that period, 24 months of probation after pleading guilty

At the end of the plea agreement, however, it was noted that the office of Commonwealth’s attorney was “fully aware” of the public interest in this case, and that a removal from office was never going to be an automatic consequence through the case’s results.

Sheriff Acree can stay in office under the convictions because the charges were not felonies, according to Marshall County Attorney Jason Darnall, who served as special prosecutor in the case.

 

It was further issued that Sheriff Aaron Acree’s status as sheriff “rests solely in the hands of other entities, which could include, but are not necessarily limited to, the Governor of the Commonwealth, the Kentucky General Assembly,” and Trigg County’s voters.

Governor Beshear said on Thursday that he and his office needed to review not only case law from the 1950s, but also Senate Bill 80; for which he codified in 2021.

Governor Beshear called all of this a two-part process before further action will be required.

In Section 3a of SB80, it states that the certification of a peace officer may be revoked by the Kentucky Law Enforcement Council for one or more of the following actions:

 

1) If the officer had willful falsification of information to obtain or maintain a certified status;
2) If the officer failed to meet and/or maintain training requirements outside of an inactive status;
3) If the officer exhibited professional malfeasance and/or nonfeasance;
4) If the officer enters a plea of guilty or an Alford, or is convicted of, any misdemeanor offense including dishonesty, fraud, deceit, misrepresentation, physical violence, sexual abuse, and/or crimes against a minor or a family or household member.

 

The KLEC was formed September 1, 1967 behind a $37,000 grant, and it serves as the governing body of standards for training academies, law enforcement instructors, curriculum, qualifications for attendance and expulsion, voluntary career development programs and other guiding efforts.

Prior to SB80, sheriffs of Kentucky were still under the subject of indictment or prosecution through Section 227 of the state’s Constitution, with the Kentucky General Assembly holding authority to codify legislation seeking any sheriff, jailer, constable or peace officer be removed from office.

Furthermore, there were two ways of removing as sheriff from office: removal of address, which required petitioning a legislative body for said removal and impeachment, and by statute, which allows the Governor’s office to remove a peace officer for neglect of duty.

Governor Beshear said he would have an update on this matter at a later time.

Kentucky State Police Post 1  in Hickory, KY., in Graves County, began investigating Sheriff Aaron Acree, who himself is a former Kentucky State Police trooper, in the spring of 2022 after receiving allegations of misconduct.
 
A Trigg County grand jury ultimately indicted Sheriff Acree in late November 2022.

One official misconduct charge involved Sheriff Acree requesting a free room at the state park lodge at Lake Barkley. He told staffers he needed the room to observe a drug transaction when it was really to meet a woman for sex, according to the court record.

 
The other official misconduct charge and the menacing charges related to an alleged assault on a woman after she was arrested.
 
Sheriff Acree went home for lunch one day in January 2022, and found Crystal Dawn Smith in his house, according to a federal lawsuit Crystal Smith later filed against Acree. 
 
Crystal Smith was arrested on charges of burglary, possession of stolen property and possession of heroin. 
 
The federal lawsuit said Crystal Smith had been abusing pain pills and heroin after the accidental gun death of her son some months before, and didn’t know whose house she had entered. 
 

Crystal Smith alleged in her lawsuit that at Sheriff Acree’s direction, the county jailer took her to the sheriff’s office before taking her to jail in neighboring Christian County.

At his office, Sheriff Acree allegedly slammed Crystal Smith against a wall while she had restraints on her hands and legs, threw her to the floor and screamed that he would “f—–g kill her if he ever saw her again,” according to a citation and the federal lawsuit.

 
Sheriff Acree denied wrongdoing in a response to the lawsuit, but pleaded guilty to misconduct and menacing in connection with the incident. 
 
The plea agreement said Crystal Smith did not seek treatment for injuries while she was an inmate and that there were no photos of bruising or other injuries. 
 

Crystal Smith pleaded guilty to burglary for entering Acree’s home, according to the plea document.

The plea document Sheriff Aaron Acree signed notes that the court and prosecutor don’t have authority to remove him from office based on the misdemeanor charges. 

 
The governor could initiate a removal action or the legislature could impeach Sheriff Acree, according to the case’s special prosecutor Marshall County Attorney Jason Darnall. 
 
Sheriff Aaron Acree’s attorney, Ken Haggard, said authorities wanted Sheriff Acree to resign, but he and attorney Haggard “absolutely refused”; and the prosecution ultimately dropped the demand. “
 
“Aaron is free to continue in office under the plea and will do so,” defense attorney Ken Haggard said.
 
Aaron Acree was appointed as sheriff of Trigg County in August 2020; and he ran for reelection in 2022 and won a full four year term.
 
Sheriff Aaron Acree’s election was not without controversy. At the time he was being investigated in 2022 by Kentucky State Police, Sheriff Acree was also facing a lawsuit accusing him of illegally suspending and firing two deputies in retaliation for them informing the FBI of “actual or suspected” law violations committed by him. Those deputies were two of the four write-in candidates running against him.
Aaron Acree, while employed as a Cadiz, KY. city police officer, he was appointed Trigg County Sheriff in August 2020, following the resignation of previous Trigg County Sheriff Jason Barnes, who himself was involved in a criminal case after being also sentenced to probation and house arrest after pleading guilty of unlawful transaction with a minor and felony tampering with evidence.

In addition to the criminal charges, ex-sheriff Jason Barnes faces a lawsuit accusing him and others of grooming a girl who became a sheriff’s office intern when she was 17.
The lawsuit accuses Jason Barnes of making inappropriate sexual advances toward the teen after she turned 18, and later plying her with alcohol and having sex with her while she was intoxicated.

    We the people are tired of the things that keep happening in our town. He is talk of the town. Some of us won’t even go into town because of him. People are scared of him. Check into the number of people he has killed. He has lies so many times. When he was having the affair, he was putting tires on her car, giving her laptops all with the county money. There are several cases against him that are still open. We want someone we can trust. Inquire if they were body cams? There have been more than one woman even when he was a KSP trooper. He has been nothing but bad news for our town. I will never trust this man or respect him.

    How are we to trust law enforcement when this stuff happens and is consistantly swept under the rug of entitlement! The actions of Acree were criminal so our system should have acted accordingly? This keeps happening.. Gov. Brashear please get him out!!!
