Martin County Grand Jury met on June 1st and issued two indictments.

Commonwealth vs. Jamie McNeely

The Grand Jury charges that on or before November 13, 2022 in Martin County, Ky the above named defendant:

Jamie McNeely
Sheriff John H. Kirk

 

  1. Jamie McNeely committed the offense of fleeing/evading in the first degree by knowingly and unlawfully disregarding signals and commands to stop given by Sheriff John Kirk with Martin County Sheriff’s Department while acting within the official capacity of his office and had reasonable suspicion that the defendant had committed a crime, namely the intent to flee, avoid or elude his arrest.

  2. Jamie McNeely committed the offense of wanton endangerment in the first degree by knowingly and unlawfully engaging in conduct which creates substantial danger of death or serious physical injury to another person, namely Sheriff John Kirk with the Martin County Sheriff’s Department.

  3. Jamie McNeely committed the offense of wanton endangerment in the first degree by knowingly and unlawfully engaging in conduct which creates substantial danger of death or serious physical injury to another person, namely Amber Harmon and her three juvenile children.

  4. Jamie McNeely committed the offense of fleeing/evading in the second degree by knowingly disobeying a command to stop by Sheriff John Kirk with the Martin County Sheriff’s Department who was acting in the official capacity of his office and had reasonable suspicion that the defendant had committed a crime.

  5. Jamie McNeely committed the violation of failure to produce insurance card by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without a proper insurance/securities card.

  6. Jamie McNeely committed the offense of license to be in possession by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without an operator’s license.

Commonwealth vs. Chad Smith

The Grand Jury charges that on or before December 22, 2021 in Martin County, Ky the above named defendant:

  1. On or before December 22, 2021 through June 8, 2022 Chad Smith committed the offense of sexual abuse in the first degree by knowingly and unlawfully subjecting a child less than sixteen years of age.
