Martin County Grand Jury met August 5, 2021 returning indictments including rape and unlawful transaction with a minor.

Commonwealth vs. Donald York

 

The Grand Jury charges that on or before July 10, 2021 in Martin County, Ky the above named defendant:

 

  1. Donald York committed the offense of rape in the first degree by knowingly and unlawfully engaging in sexual intercourse with another person, a minor, by forcible compulsion.

  2. Donald York committed the offense of unlawful transaction with a minor in the first degree by knowingly and unlawfully inducing, assisting, and/or causing a minor, a minor, to engage in illegal controlled substance activity in the form of ingestion of non-prescribed Gabapentin.

  3. Donald York committed the offense of unlawful transaction with a minor in the second degree by knowingly and unlawfully inducing, assisting and/or causing a minor, a minor, to engage in illegal controlled substance activity involving Marijuana.

  4. Donald York defendant committed the offense of possession or viewing of matter portraying a sexual performance by a minor by knowingly, having acknowledge of its content, character and that the sexual performance is by a minor, he knowingly had in his possession or control or viewing matters which visually depicted an actual sexual performance by a minor person, a minor.

 

 

Commonwealth vs. Melissa Dawn Seay

 

The Grand Jury charges that on or before March 15,  2021 in Martin County, Ky the above named defendant:

 

  1. Melissa Dawn Seay committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of Fentanyl.

  2. Melissa Dawn Seay committed the offense of use/possession of drug paraphernalia by knowingly and unlawfully being in possession of syringes and altered spoons.

 

Commonwealth vs. Lonnie Ray Jude

 

The Grand Jury charges that on or before March 15, 2021 in Martin County, Ky the above named defendant:

 

  1. Lonnie Ray Jude committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of Heroin.

 

Commonwealth vs. Gladys Maynard

 

The Grand Jury charges that on or before April 2,  2021 in Martin County, Ky the above named defendant:

 

  1. Gladys Maynard committed the offense of theft of services over $500.00 but under $10,000.00 by intentionally obtaining services, namely water, from the Martin County Water Company, to avoid services known to only be available only for compensation in an amount exceeding $500.00.

 

Commonwealth vs. Floyd A. Luster III

 

The Grand Jury charges that on or before April 29, 2021 in Martin County, Ky the above named defendant:

 

  1. Floyd A. Luster committed the offense of wanton endangerment in the first degree by knowingly and unlawfully engaging in conduct which created a substantial danger to another, namely Mr. Johnny King of Inez, Ky.

  2. Floyd A. Luster committed the offense of criminal mischief second degree by knowingly and unlawfully defacing, destroying, or damaging property, namely track owned by mr. Johnny King of Inez, Ky.

 

Commonwealth vs. Melinda Mullins

 

The Grand Jury charges that on or before July 15, 2020 in Martin County, Ky the above named defendant:

 

  1. Melinda Mullins committed the offense of theft by unlawful taking over $500.00 uner $10,000.00 by knowingly and unlawfully taking a 2001 Mercury Sable automobile from Eddie Stepp of Inez, Ky with the value of the items taken exceeding $500.00.

 

Commonwealth vs. Travis Pierce

 

The Grand Jury charges that on or before August 26, 2020 in Martin County, Ky the above named defendant:

 

  1. Travis Pierce committed the offense of theft by unlawful taking over $500.00 under $10,000.00 by knowingly and unlawfully taking a set of bolt cutters, a grease gun, a hammer, fuel filter, spike strips and three batteries with the value of the items taken exceeding $500.00.

 

Commonwealth vs. Megan Maynard

 

The Grand Jury charges that on or before June 25, 2020 in Martin County, Ky the above named defendant:

 

  1. Megan Maynard committed the offense of assault in the third degree by knowingly and unlawfully physically assaulting or attempting to assault Deputy Earnie Fannin with the Martin County Sheriff’s Department, while acting in the capacity of his office.

  2. Megan Maynard committed the offense of disorderly conduct in the second degree by knowingly and unlawfully engaging in violent or threatening behavior in a public place with the intent to cause public inconvenience, annoyance, and/or alarm.

 

Commonwealth vs. Michael Farley

 

The Grand Jury charges that on or before July 6, 2020  in Martin County, Ky the above named defendant:

 

  1. Michael Farley committed the offense of assault in the third degree by knowingly and unlawfully physically assaulting or attempting to assault Deputy William Lafferty and Sheriff John Kirk with the Martin County Sheriff’s Department, while acting in the capacity of his office.

  2. Michale Farley named defendant committed the offense of criminal mischief in the second degree by knowingly and unlawfully damaging property owned and operated by the Brookshire Inn, located in Inez, Ky.

 

Commonwealth vs. Ashley Salmons

 

The Grand Jury charges that on or before January 14, 2021 in Martin County, Ky the above named defendant:

 

  1. Ashley Salmons committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of Methamphetamine.

  2. Ashley Salmons committed the offense of operating a motor vehicle on suspended or revoked license by knowingly and unlawfully operating a motor vehicle while his license to operate said motor vehicle had been suspended or revoked.

 

Commonwealth vs. April Trombley

 

The Grand Jury charges that on or before February 29, 2020in Martin County, Ky the above named defendant:

 

  1. April Trombley acting alone or in complicity with Phillip Johnson committed the offense of burglary in the third degree by knowingly and unlawfully entering a building owned and operated by the Martin County Board of Education with the intent therein to commit the crime of theft.

 

Commonwealth vs. Phillip Johnson 

 

The Grand Jury charges that on or before February 29, 2020 in Martin County, Ky the above named defendant:

 

  1. Phillip Johnson acting alone or in complicity with April Trombley committed the offense of burglary in the third degree by knowingly and unlawfully entering a building owned and operated by the Martin County Board of Education with the intent therein to commit the crime of theft.

 

Commonwealth vs. Ernest Maynard 

 

The Grand Jury charges that on or before June 9, 2020 in Martin County, Ky the above named defendant:

 

  1. Ernest Maynard committed the offense of operating a motor vehicle while under the influence of alcohol/drugs, fourth or greater offense , aggravating circumstances by operating a motor vehicle while under the influence of alcohol or other substances that impair a driver’s ability to operate a motor vehicle with least four prior convictions within a ten year period.

  2. Ernest Maynard, having been charged in the instant indictment with the above stated felony, is now being charged as a persistent felony offender in the second degree.

  3. Ernest Maynard committed the offense of driving DUI suspended, second offense or greater by knowingly and unlawfully being in physical control of the motor vehicle while his operator’s license was suspended for a violation.

 

Commonwealth vs. Kelly Ray Click 

 

The Grand Jury charges that on or before August 3, 2021 in Martin County, Ky the above named defendant:

 

  1. Kelly Ray Click committed the offense of possession of a firearm by a convicted felon by possession of a .38 caliber 2 shot Derringer handgun after having been previously convicted of a felony.

 

Commonwealth vs. Todd Whitt

 

The Grand Jury charges that on or before June 5, 2021 in Martin County, Ky the above named defendant:

 

  1. Kelly Ray Click committed the offense of assault in the first degree when he intentionally caused serious physical injury to Niki J. Boles, by means of a deadly instrument.

  2. Kelly Ray Click committed the offense of assault in the first degree when he intentionally caused serious physical injury to Shawn Blevins, by means of a deadly instrument.

 

Commonwealth vs. Alicia Glispy

 

The Grand Jury charges that on or before September 1, 2017 in Martin County, Ky the above named defendant:

 

  1. Alicia Glispy acting alone or in complicity with Carles Glispy committed the offense of false/misinterpretation statements to obtain welfare benefits by knowingly and unlawfully with intent to defraud, made a false statement or by other means fails to disclose a material fact used in determining the person’s qualification to receive benefits under any assistance program, or with intent to defraud, fail to report a change in the factors affecting the person’s eligibility for benefits, resulting in the overpayment of SNAP Benefits of $16,126.00.

  2. Alicia Glispy acting along or in complicity with Charles Glispy committed the offense of false statements to obtain welfare benefits by knowingly and unlawfully with intent to defraud, made a false statement by other means fails to disclose a material fact used in determining the person’s qualification to receive benefits under any assistance program, or with intent to defraud, fail to report a change in factors affecting the person’s eligibility for benefits, resulting in the overpayment of Medicaid benefits of $34,065.26.

 

Commonwealth vs. Charles Glispy

 

The Grand Jury charges that on or before September 1, 2017 in Martin County, Ky the above named defendant:

 

  1. Charles  Glispy acting alone or in complicity with Alicia  Glispy committed the offense of false/misinterpretation statements to obtain welfare benefits by knowingly and unlawfully with intent to defraud, made a false statement or by other means fails to disclose a material fact used in determining the person’s qualification to receive benefits under any assistance program, or with intent to defraud, fail to report a change in the factors affecting the person’s eligibility for benefits, resulting in the overpayment of SNAP Benefits of $16,126.00.

Commonwealth vs. Rhoads Dials

 

The Grand Jury charges that on or before July 27, 2021 in Martin County, Ky the above named defendant:

 

  1. Rhoads Dials committed the offense of rear license not illuminated by operating a motor vehicle without the rear license illuminated and within the hours designated.

  2. Rhoads Dials committed the offense of operating a motor vehicle on a DUI suspended operator’s license by knowingly and unlawfully operating and/or being in physical control of a motor vehicle while his operator’s license was suspended.

  3. Rhoads Dials committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, namely Methamphetamine.

  4. Rhoads Dials committed the offense of possession of a controlled substance

In the first degree by knowingly and unlawfully being in possession of a controlled

           substance, namely Heroin.

  1. Rhoads Dials committed the offense of use/possession of drug paraphernalia by knowingly and unlawfully being in possession of bags containing controlled substances as well as a set of digital scales used to weigh controlled substances.

 

Commonwealth vs. Justin Matthew Mollette

 

The Grand Jury charges that on or before June 29, 2021 in Martin County, Ky the above named defendant:

 

  1. Justin Mollete committed the offense of operating a motor vehicle on a DUI suspended operator’s license by knowingly and unlawfully operating and/or being in physical control of a motor vehicle while his operator’s license was suspended.

  2. Justin Mollette committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance namely Methamphetamine.

  3. Justin Mollette committed the offense of use/possession of drug paraphernalia by knowingly and unlawfully being in possession of glass pipes using the ingest controlled substance.
