Martin County Grand Jury Issued Indictments On October 5

The Martin County Grand Jury issued indictments on October 5th. 

Commonwealth of Kentucky vs. Selwyn Brewer

The Grand Jury charges: That on or before July 10, 2023, in Martin Co, Kentucky, and before the finding of the indictment herein, the above-named defendant:

  1. Selwyn Brewer committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of Methamphetamine.

  2. Selwyn Brewer committed the offense of possession/use of drug paraphernalia by knowingly and unlawfully being in possession of an altered glass pipe.

  3. Selwyn Brewer committed the offense of driving DUI suspended in the first offense by knowingly and unlawfully being in physician control of the motor vehicle while his operator’s license was suspended for a violation.

  4. Selwyn Brewer committed the offense of resisting arrest by knowingly, intentionally, and unlawfully attempting to prevent officers with the Martin County Sheriff’s Department from effecting an arrest by using, or threatening to use, physical force against said police officers.

Commonwealth of Kentucky vs. Joann Reed

The Grand Jury charges: That on or before May 15, 2023, in Martin Co,  Kentucky, and before the finding of the indictment herein, the above-named defendant:

  1. Joann Reed committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of Oxycodone.

  2. Joann Reed committed the offense of prescription controlled substance not in the proper possession of two Naloxone strips not in the proper administered container.

  3. Joann Reed committed the violation of alcohol intoxication in a public place by knowingly and unlawfully appearing in a public place manifestly under the influence of alcohol to the degree that he may endanger himself or other persons or property or unreasonably annoy persons in his vicinity.

Commonwealth of Kentucky vs. Jonathan Mollett

The Grand Jury charges: That on or about September 27, 2023, in Martin Co, Kentucky, and before the finding of the indictment herein, the above-named defendant:

  1. Jonathan Mollett committed the offense of possession of a firearm by a convicted felon by being in possession of a Ithica brand 12 gauge shotgun after having been previously convicted of a felony.

Commonwealth of Kentucky vs. Gwyan Horn 

The Grand Jury charges: That on or about September 13, 2023, in Martin Co,  Kentucky, and before the finding of the indictment herein, the above-named defendant:

  1. Gwyan Horn committed the offense of terroristic threatening in the second degree when he intentionally threatened to commit any act likely to result in death or serious physical injury to any person, at a schedule event, any person at a place of worship, any student group, teacher, volunteer worker, or employee of a public or private elementary or secondary school, vocational school, or institution of post secondary educations, or to any other person reasonably expected to lawfully be on school property or at a school sanctioned activity, if that threat is related to their employment by the school, or work, or attendance at the school or school function, namely Shane Stafford, Principal of Eden Elementary, while acting within his official capacity.

Commonwealth of Kentucky vs. Nathan Blackburn

The Grand Jury charges: That on or about July 26, 2022, in Martin Co, Kentucky, and before the finding of the indictment herein, the above-named defendant:

  1. Nathan Blackburn committed the offense of sexual abuse in the first degree by knowingly and unlawfully subjecting a minor under the age of twelve for sexual contact.

Commonwealth of Kentucky vs. John Perry

The Grand Jury charges: that on the dates set forth in the charges below, in Martin Co,  Kentucky, and before the finding of the indictment herein, the above-named defendant:

  1. On or about March 31, 2023, John Perry committed the offense of sexual abuse in the first degree by knowingly and unlawfully subjecting a minor under the age of twelve for sexual contact.

  2. On or about April 5, 2015 the above named defendant committed the offense of sexual abuse in the first degree by knowingly and unlawfully subjecting a minor under the age of twelve.

  3. On or about April 1, 2018 the above named defendant committed the offense of sexual abuse in the first degree by while being twenty one years of age or older, knowingly and unlawfully subjecting a minor under the age of sixteen.

Commonwealth of Kentucky vs. Denver Messer

The Grand Jury charges: That on or about July 15, 2021, in Martin Co, Kentucky, and before the finding of the indictment herein, the above-named defendant:

  1. Denver Messer committed the offense of burglary in the second degree by knowingly and unlawfully entering the dwelling house/apartment of Kayla Fugate, with the intent therein to commit the crime of assault.

  2. Denver Messer committed the offense of burglary in the third degree by knowingly and unlawfully entering and remaining at the Dempsey Housing Apartment Complex after having been banned from the property and the complex previously.

  3. Denver Messer committed the offense of possession of burglar’s tools by knowingly and unlawfully being in possession of a tool, instrument commonly used to facilitate or commit the commission of an offense involving forcible entry into premises, namely a claw hammer used for prying with pry marks being found on a sliding glass door at the residence.

  4. Denver Messer committed the offense of assault in the fourth degree (domestic violence) he knowingly and unlawfully assaulted his former domestic partner, Kayla Fugate, causing physical injury to her.

  5. Denver Messer committed the offense of terroristic threatening in the third degree by knowingly and unlawfully threatening to commit the crime of murder/and or assault against Kayla Fugate.

 

An indictment is not proof of guilt.
