MARTIN COUNTY GRAND JURY HANDS DOWN SEVEN INDICTMENTS

Martin Co Indictments, October 8, 2021

 

Martin County Grand Jury handed down seven indictments including fleeing and giving an officer false information, assault, strangulation and unlawful imprisonment.

 

Commonwealth vs. Fred Daniels Jr.

 

The Grand Jury charges that on or before August 19, 2021 in Martin Co, Ky the above named defendant:

 

1. Fred Daniels committed the offense of possession of a controlled substance (Methamphetamine) in the first degree.

 

2. Fred Daniels committed the offense of possession of drug paraphernalia by being in possession of an altered pipe.

 

3. Fred Daniesl committed the offense of operating on a revoked or suspended operator’s license by operating a vehicle on the roadway while his license was suspended or revoked.

 

4. Fred Daniels committed the offense of failure to maintain required insurance by operating a vehicle without possessing the requisite vehicle insurance.

 

5. Fred Daniels committed the violation of no/expired registration plates by operating a vehicle without proper registration.

 

Commonwealth vs. Chris Maynard
The Grand Jury charges that on or before July 28,  2021 in Martin Co, Ky the above named defendant:

 

1. Chris Maynard committed the offense of possession of a firearm by a convicted felony by possessing a Ruger brand .9mm handgun after having been previously convicted of two prior felonies.

 

Commonwealth vs. Chiris Maynard 
The Grand Jury charges that on or before August 19, 2021 in Martin Co, Ky the above named defendant:

 

1. Chris Maynard committed the offense of receiving stolen property (firearm) by being in possession of a Ruger brand .9mm caliber handgun reported as stolen out of the State of West Virginia.

 

2. Chris Maynard committed the offense of possession of a police radio by being in possession of a radio that sends or receives emergency messages.

 

3. Chris Maynard having been charged in the instant indictment with the above stated felony counts is now being charged as a persistent felony offender.

 

 

Commonwealth vs. Jimmy Scott
The Grand Jury charges that on or before June 7,  2021 in Martin Co, Ky the above named defendant:

 

1. Jimmy Scott committed the offense of strangulation by intentionally, without consent, impeding the normal breathing or circulation of the blood of another, applying pressure to the throat or neck of another, or by blocking the nose or mouth of another person, namely Desiree Scott.

 

2. Jimmy Scott committed the offense of assault in the fourth degree by physically assaulting Desiree Scott.

 

3. Jimmy Scott committed the offense of unlawful imprisonment in the second degree by restraining the liberty of Desiree Scott.

 

Commonwealth vs. Cody Spears
The Grand Jury charges that on or before July 29, 2021 in Martin Co, Ky the above named defendant:

 

1. Cody Spears acting alone or in complicity with James Bailey, committed the offense of trafficking in a controlled substance in the first degree by being in possession of Methamphetamine, $1899.00 in cash money, digital scales, and multiple individual baggies, with the intent to traffick or by trafficking in that Methamphetamine.

 

2. Cody Spears acting alone or in complicity with James Bailey committed the offense of possession of a controlled substance in the third degree by being in possession of numerous Xanax dosage units.

 

3. Cody Spears acting alone or in complicity with James Bailey, committed the offense of trafficking in a controlled substance in the first degree by being in possession of Marijuana , $1899.00 in cash money, digital scales, and multiple individual baggies, with the intent to traffick or by trafficking in that Methamphetamine.

 

Commonwealth vs. James Bailey 
The Grand Jury charges that on or before July 29, 2021 in Martin Co, Ky the above named defendant:
1. James Bailey  acting alone or in complicity with Cody Spears, committed the offense of trafficking in a controlled substance in the first degree by being in possession of Methamphetamine, $1899.00 in cash money, digital scales, and multiple individual baggies, with the intent to traffick or by trafficking in that Methamphetamine.
2. James Bailey  acting alone or in complicity with Cody Spears committed the offense of possession of a controlled substance in the third degree by being in possession of numerous Xanax dosage units.
3. James Bailey  acting alone or in complicity with Cody Spears, committed the offense of trafficking in a controlled substance in the first degree by being in possession of Marijuana , $1899.00 in cash money, digital scales, and multiple individual baggies, with the intent to traffick or by trafficking in that Methamphetamine.

 

4. James Bailey committed the offense of fleeing/evading in the second degree by disobeying a command to stop by Deputy William Lafferty, Deputy David Adams with the Martin County Sheriff’s Department and Trooper Ryan Hale with the Kentucky State Police who were working within their official capacity as police offenders.

 


Commonwealth vs. Ricky L. Gauze
The Grand Jury charges that on or before July 11, 2021 in Martin Co, Ky the above named defendant:

 

1. Ricky Gauze committed the offense of possession of a controlled substance in the first degree by being in possession of Methamphetamine.

 

2. Ricky Gauze committed the offense of assault in the third degree by physically assaulting or attempting to assault Deputy David Adams with the Martin County Sheriff’s Department while acting in the capacity of his office.

 

3. Ricky Gauze committed the offense of fleeing/evading in the second degree by disobeying a command to stop by Deputy David Adams who had reasonable suspicion that the defendant had committed a crime.

 

4. Ricky Gauze committed the offense of giving an officer false name with the intent to mislead an officer as to his identity, gaave Deputy David Adams a false name and biometric information.

 

5. Ricky Gauze committed the offense of possession of a controlled substance in the second degree by being in possession of Suboxone, a schedule III controlled substance.
