HERE ARE THE NAMES & CHARGES OF THE LATEST TWENTY-SEVEN (27) PEOPLE WHO WERE ARRESTED AND TAKEN INTO CUSTODY IN MARTIN COUNTY OR ANY MARTIN COUNTY CITIZENS ARRESTED BY A POLICE AGENCY IN NEIGHBORING JURISDICTIONS:

James E. Stanley, 43, of Canada, Kentucky; was arrested on November 30, 2020,at 4:38 P.M.,by Sheriff John H. Kirk, & deputy William Tyler Lafferty, of the Martin County Sheriff Department, and was charged with:

• DRIVING 16 MPH OVER LIMIT,

• DRIVING DUI SUSPENDED LICENSE – 2ND OFFENSE,

• TRAFFICKING IN MARIJUANA (LESS THAN 8 OZ.).

Donald G. Porter, 60, of Debord, Kentucky; was arrested on November 30, 2020, at 8:18 P.M.,by a trooper of the Kentucky State Police,Post 9, Pikeville, Ky.,& was charged with:

• OPERATING MOTOR VEHICLE UNDER/ INFLUENCE ALCOHOL .08 (189A.010(1A) – 1ST OFFENSE,

• REAR LICENSE NOT ILLUMINATED,

• FAILURE TO WEAR SEAT BELTS,

• FAILURE TO PRODUCE INSURANCE CARD,

• POSSESSION OF OPEN ALCOHOL BEVERAGE CONTAINER IN MOTOR VEHICLE PROHIBITED.

Mikaela Horn, 25, of Inez, Kentucky; was arrested on December 1, 2020, at 1:57 P.M.,by deputy William Tyler Lafferty, of the Martin County Sheriff Department, & was charged with:

• SERVING BENCH WARRANT FOR COURT.

Stephen M. Hammonds, 31, of Beauty, Kentucky; was arrested on December 2, 2020, at 9:07 P.M., by deputy David Adams, of the Martin County Sheriff Department, and was charged with:

• ALCOHOL INTOXICATION IN A PUBLIC PLACE (1ST & 2ND OFFENSE),

• CRIMINAL TRESPASSING-2ND DEGREE.

Cody G. Spears, 25, of Lovely, Kentucky; was arrested December 4, 2020, at 5:53 A.M., by deputy David Adams, of the Martin County Sheriff Department, & was charged with:

• TRAFFICKING IN CONTROLLED SUBSTANCE 1ST OFFENSE,

• TRAFFICKING IN MARIJUANA(8 OZ TO < 5 LBS.) 1ST OFFENSE,

• DRUG PARAPHERNALIA – BUY/POSSESS.

Gary Hayes, 52, of Kermit, West Virginia; was arrested December 4, 2020, at 6:03 A.M., by deputy William Tyler Lafferty, of the Martin County Sheriff Department, & was charged with:

• POSSESSION CONTROLLED SUBSTANCE 1ST DEGREE, 1ST OFFENSIVE (METHAMPHETAMINE),

• POSSESSION OF MARIJUANA,

• DRUG PARAPHERNALIA – BUY/POSSESS.

According to the arrest citation report, one clear bag with a crystal-like substance in a flower pot within arm’s reach of Gary Hayes, along with a pink zip-up bag with a clear homemade pipe and a purple straw. Two bags of what appear to be marijauna was found in his back right pocket.


Aaron Jude, 25, of Lovely, Kentucky; was arrested December 4, 2020, at 6:13 A.M., by deputy William Tyler Lafferty, of the Martin County Sheriff Department, & was charged with:

• POSSESSION CONTROLLED SUBSTANCE 1ST DEGREE, 1ST OFFENSIVE (METHAMPHETAMINE),

• DRUG PARAPHERNALIA – BUY/POSSESS.

According to the arrest citation report, Sheriff John H. Kirk wrote that Aaron Jude had five used syringes inside his left front jean pocket and one clear bag with a crystal-like substance in a flower pot within arm’s reach of Aaron Jude.

Jackson Taylor Fitch, 28, of Kermit, West Virginia; was arrested December 4, 2020, at 6:45 A.M., by deputy William Tyler Lafferty, of the Martin County Sheriff Department, and was charged with:

• PUBLIC INTOXICATION-CONTROLLED SUBSTANCE (EXCLUDES ALCOHOL).

According to the arrest citation report, Sheriff John H. Kirk wrote that Jackson Fitch was outside the residence and appeared to be under the influence. Sheriff Kirk further stated in the report on Jackson Fitch, “Subject could not stand still and would not stop talking out his head.”

 


Tommie Spears, 58, of Lovely Kentucky; was arrested December 4, 2020, at 6:55 A.M., by deputy William Tyler Lafferty,of the Martin County Sheriff Department, and was charged with:

• TRAFFICKING IN CONTROLLED SUBSTANCE 1ST OFFENSE,

• TRAFFICKING IN MARIJUANA(8 OZ TO < 5 LBS.) 1ST OFFENSE, DRUG PARAPHERNALIA – BUY/POSSESS,

• THEFT BY UNLAWFUL TAKING – FIREARM,

• DEFACING A FIREARM.

According to the arrest citation report, Sheriff John H. Kirk wrote that three firearms of the forty-one that were located at Tommie Spears residence were illegal. Sheriff Kirk wrote that two of the guns were reported stolen – an SKS 7.62MM, and a Remington model 582, while one handgun had the serial number removed.


Nathaniel Maynard, 27, of Lovely, Kentucky; was arrested December 4,2020, at 7:15 A.M. by deputy William Tyler Lafferty, of the Martin County Sheriff Department, and was charged with:

• POSSESSION CONTROLLED SUBSTANCE 1ST DEGREE, 1ST OFFENSIVE (METHAMPHETAMINE),

• THEFT BY UNLAWFUL TAKING ALL OTHERS UNDER/$500,

• DISORDERLY CONDUCT, 2ND DEGREE.

According to the arrest citation report, deputy Lafferty wrote that one clear bag with a crystal-like substance was located inside a flower pot within arm’s reach of Nathaniel Maynard. The citation report added that while Nathaniel Maynard was in the booking room of the sheriff’s office, and he was also still handcuffed, he was searched and one pocket knife was located in his right front jacket pocket. According to the arrest citation report, the pocket knife was taken out of the deputy’s file box.

“While in the booking room while waiting for transport to arrive, Nathaniel Maynaard would not stop cussing, and called Sheriff John Kirk a son of a bitch,” deputy Lafferty finished up his writing in the arrest citation report.


Laura D. Giacomoni, 37, of Lovely, Kentucky; was arrested December 4,2020, at 7:25 A.M.,by deputy William Tyler Lafferty, of the Martin County Sheriff Department, and was charged with:

• TRAFFICKING IN CONTROLLED SUBSTANCE 1ST OFFENSE,

• TRAFFICKING IN MARIJUANA(8 OZ TO < 5 LBS.) 1ST OFFENSE-(2 SEPARATE CHARGE COUNTS), DRUG PARAPHERNALIA – BUY/POSSESS.


Ruby Chaffins, 45, of Lovely, Kentucky; was arrested December 4, 2020, by deputy William Tyler Lafferty,of the Martin County Sheriff Department,& was charged with:

• TRAFFICKING IN CONTROLLED SUBSTANCE 1ST OFFENSE,

• TRAFFICKING IN MARIJUANA(8 OZ TO < 5 LBS.) – 1ST OFFENSE, DRUG PARAPHERNALIA – BUY/POSSESS.

James Michael Bailey, 46, of Louisville, Kentucky; was arrested December 3, 2020, by deputy William Tyler Lafferty, and was booked at the Big Sandy Regional, on December 4, 2020, at 7:45 A.M., and was charged with:

• POSSESSION CONTROLLED SUBSTANCE 1ST DEGREE, 1ST OFFENSIVE (METHAMPHETAMINE) – [2 SEPARATE CHARGE COUNTS],

• TAMPERING WITH EVIDENCE.

According to the arrest citation report, one clear bag with a crystal-like substance was located inside a flower pot within arm’s reach of James Bailey. Sheriff Kirk wrote further in the report that James Bailey was searched in the booking room of the sheriff’s office, and officers found two clear bags with a crystal like substance in his jacket pocket. Sheriff Kirk finished up the report in a written quote, “Bailey had eaten the substance that was inside the bags.”

Ryan N. Marcum, 34, of Warfield, Kentucky; was arrested on December 4, 2020, at 3:58 P.M.,by Constable James Bradford Preece, of the Martin County Constable Office-District 4, & was charged with:

• PUBLIC INTOXICATION-CONTROLLED SUBSTANCE (EXCLUDES ALCOHOL),

• ENDANGERING THE WELFARE OF A MINOR (2 SEPARATE CHARGES COUNTS).

 

James Brandon Preece, 34, of Inez, Kentucky; was arrested on December 4, 2020, at 9:29 P.M.,by deputy William Tyler Lafferty, of the Martin County Sheriff Department, & was charged with:

• OPERATING MOTOR VEHICLE UNDER/INFLUENCE CONTROLLED SUBSTANCE (189A.010(1D) – 1ST OFFENSE.

 


Rhonda L. Chafin, 40, of Jacksonville, Florida; was arrested on December 5, 2020, at 11:51 P.M.,by deputy Billy Patrick, of the Martin County Sheriff Department, & was charged with, via grand jury indictment:

• TRAFFIC CONTROLLED SUBSTANCE 1ST DEGREE,1ST OFFENSE – (< 10 D.U. OPIATES),

• SERVING BENCH WARRANT FOR COURT.

Leslie K. Maynard, 41, of Inez, Kentucky; was arrested on December 6, 2020, at 2:21 A.M.,by Constable Tony Preece, of the Martin County Constable Office -District 2, & was charged with:

• CRIMINAL MISCHIEF 3RD DEGREE (3 SEPARATE CHARGE COUNTS),

• ESCAPE 3RD DEGREE (2 SEPARATE CHARGE COUNTS),

• CRIMINAL MISCHIEF, 1ST DEGREE,

• DISORDERLY CONDUCT, 2ND DEGREE,

• MENACING,

• INDECENT EXPOSURE, 2ND DEGREE,

• TERRORISTIC THREATENING, 3RD DEGREE,

• WANTON ENDANGERMENT-2ND DEGREE,

• PUBLIC INTOXICATION-CONTROLLED SUBSTANCE (EXCLUDES ALCOHOL).


Annie N. Maynard, 34, of Pilgrim, Kentucky; was arrested on December 7, 2020, at 9:53 P.M.,by deputy William Tyler Lafferty, of the Martin County Sheriff Department, & was charged with:

• OPERATING MOTOR VEHICLE UNDER/INFLUENCE ALCOHOL .08 (189A.010(1A) – 1ST OFFENSE,

• FAILURE TO WEAR SEAT BELTS,

• FAILURE TO PRODUCE INSURANCE CARD,

• NO REGISTRATION RECEIPT,

• DRUG PARAPHERNALIA – BUY/POSSESS,

• POSSESSION OF MARIJUANA,

• TAMPERING WITH PHYSICAL EVIDENCE,

• POSSESSION CONTROLLED SUBSTANCE, 2ND DEGREE – DRUG UNSPECIFIED.

Ryan N. Marcum, 34, of Warfield, Kentucky; was arrested December 11, 2020, at 12:04 A.M.,by deputy William Tyler Lafferty, of the Martin County Sheriff Department, and was charged with:

• ASSAULT, 4TH DEGREE (DOMESTIC VIOLENCE) MINOR INJURY.

Kendra Davis, 26, of Warfield, Kentucky; was arrested December 11,2020, at 12:04 A.M., by deputy William Tyler Lafferty, of the Martin County Sheriff Department, and was charged with:

• ASSAULT, 4TH DEGREE (DOMESTIC VIOLENCE) MINOR INJURY.

Scottie R. Thompson, 33, of Warfield, Kentucky; was arrested December 11, 2020, at 12:12 A.M.,by deputy William Tyler Lafferty,of the Martin County Sheriff Department, and was charged with:

• ASSAULT, 4TH DEGREE (DOMESTIC VIOLENCE) MINOR INJURY.

Donald J. Wiley, 35, of Inez ,Kentucky; was arrested December 11,2020, at 12:20 A.M., by deputy William Tyler Lafferty, of the Martin County Sheriff Department, and was charged with:

• ASSAULT, 4TH DEGREE (DOMESTIC VIOLENCE) MINOR INJURY.

Burlson Harmon, 68, of Debord, Kentucky; was arrested on December 11, 2020, at 3:16 A.M., by trooper Joseph E. Weddington, of the Kentucky State Police,Post 9, Pikeville, Ky.,& was charged with:

• LEAVING SCENE OF ACCIDENT-FAILURE TO RENDER AID OR ASSISTANCE,

• OPERATING MOTOR VEHICLE UNDER/INFLUENCE ALCOHOL/SUBSTANCE (189A.010(1E) – 1ST OFFENSE (AGGRAVATING CIRCUMSTANCES),

• FAILURE TO WEAR SEAT BELTS,

• FAILURE TO PRODUCE INSURANCE CARD,

• POSSESSION OF OPEN ALCOHOLIC BEVERAGE CONTAINER IN MOTOR VEHICLE PROHIBITED.

Kody Allen Endicott, 26, of Debord, Kentucky; was arrested on December 11, 2020,at 3:16 A.M.,by trooper Ryan Hale, of the Kentucky State Police,Post 9, Pikeville, Ky.,& was charged with:

• LEAVING SCENE OF ACCIDENT-FAILURE TO RENDER AID OR ASSISTANCE,

• DRIVING FROM SIDE TO SIDE OF HIGHWAY (OBS),

• FAILURE TO WEAR SEAT BELTS,

• DRIVING DUI SUSPENDED LICENSE – 1ST OFFENSE (AGGRAVATING CIRCUMSTANCES).

David Jackson Hammond, 62, of Tomahawk, Kentucky; was arrested on December 12, 2020, at 12:45 A.M., and was charged with:

• POSSESSION OF MARIJUANA.

James R. Harless, 28, of Tomahawk, Kentucky; was arrested on December 12, 2020, at 12:45 A.M., and was charged with:

• CULTIVATE IN MARIJAUNA – 5 PLANTS – 1ST OFFENSE.

Shawn S. Fitch, 26, of Inez, Kentucky; was arrested on December 13, 2020, at 9:30 P.M.,by trooper Ryan Hale, of the Kentucky State Police, Post 9, Pikeville, Ky.,& was charged with:

• OPERATING MOTOR VEHICLE UNDER/ INFLUENCE CONTROLLED SUBSTANCE (189A.010(1D) – 1ST OFFENSE,

• NO OPERATORS-MOPED LICENSE,

• IMPROPER EQUIPMENT,

• REAR LICENSE NOT ILLUMINATED,

• SEAT BELT ANCHOR ,

• OBSTRUCTED VISION AND/OR WINDSHIELD,

• FAILURE TO PRODUCE INSURANCE CARD,

• NO REGISTRATION RECEIPT,

• FAILURE OF OWNER TO MAINTAIN REQUIRED INSURANCE/SECURITY, 1ST OFFENSE.
