MANSLAUGHTER, STRANGULATION AND THREATENING DEPUTY AMONG MARTIN COUNTY INDICTMENTS

Martin County Grand Jury met on January 5, 2023 and started off the new year with a slew of indictments including manslaughter as Timothy Ramey is charged with manslaughter in the second degree by causing the death of Brenda Maynard in an auto accident. There is also a strangulation charge and thefts of over $1,000 in copper from AT&T.

 

Many of the new charges by the Martin Co. GJ involve illegal drug activity, as usual,

 

Commonwealth vs. Christopher Maynard
The Grand Jury charges that on or before August 13, 2022 in Martin County, Ky the above named defendant:

  1. Christopher Maynard committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

Commonwealth vs. Taylor Howell
The Grand Jury charges that on or before November 25, 2022 in Martin County, Ky the above named defendant:

  1. Taylor Howell committed the offense of theft by unlawful taking over $1000 under $10000 by knowingly and unlawfully taking $3490.26 in copper transmission line owned and maintained by AT&T.
  2. Taylor Howell committed the violation of Air Pollution Standards and Rules by knowingly and unlawfully burning contaminants and other materials defined in KRS:224.20-110.

Commonwealth vs. Bart Horne
The Grand Jury charges that on or before December 20, 2022 in Martin County, Ky the above named defendant:

  1. Bart Horne committed the offense of strangulation by intentionally, without consent, impeding the normal breathing or circulation of the blood of another, applying pressure to the throat or neck of another by blocking the nose or mouth of another person, namely Sierra Dingess.
  2. Bart Horne committed the offense of assault in the fourth degree by knowingly and unlawfully physically assaulting Sierra Dingess.
  3. Bart Horne committed the offense of unlawful imprisonment in the second degree by knowingly and unlawfully restraining the liberty of Sierra Dingess.

Commonwealth vs. James Harmon
The Grand Jury charges that on or before October 29, 2022 in Martin County, Ky the above named defendant:

  1. James Harmon committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, Heroin.
  2. James Harmon committed the offense of failure of owner to maintain required insurance by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without proper securities insurance.
  3. James Harmon committed the offense of violation of no registration plates by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without proper registration plates.
  4. James Harmon committed the violation of no expired registration  by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without proper registration.
  5. James Harmon committed the violation by knowingly and unlawfully being in physical control of a motor vehicle operating on the wrong side of a Kentucky roadway.

Commonwealth vs. Timothy Ramey
The Grand Jury charges that on or before April 3, 2022 in Martin County, Ky the above named defendant:

  1. Timothy Ramey committed the offense of Manslaughter in the second degree  by behaving wantonly, causing the death of Brenda Maynard.

Commonwealth vs. John Pack
The Grand Jury charges that on or before November 17, 2022 in Martin County, Ky the above named defendant:

  1. John Pack acting alone or in complicity with Taylor Howell committed the offense of theft by unlawful taking over $1000 under $10000 by knowingly and unlawfully taking $3490.26 in copper transmission line owned and maintained by AT&T.
  2. John Pack acting alone or in complicity with Taylor Howell, committed the offense of criminal mischief in the first degree by knowingly and unlawfully damaging property owned and maintained by AT&T with the damages to the property exceeding $1000.

Commonwealth vs. Taylor Howell 
The Grand Jury charges that on or before November 17, 2022 in Martin County, Ky the above named defendant:

  1. Taylor Howell acting alone or in complicity with John Pack committed the offense of theft by unlawful taking over $1000 under $10000 by knowingly and unlawfully taking $3490.26 in copper transmission line owned and maintained by AT&T.
  2. Taylor Howell acting alone or in complicity with John Pack, committed the offense of criminal mischief in the first degree by knowingly and unlawfully damaging property owned and maintained by AT&T with the damages to the property exceeding $1000.

Commonwealth vs. Leslie Maynard
The Grand Jury charges that on or before November 5, 2022 in Martin County, Ky the above named defendant:

  1. Leslie Maynard committed the offense of criminal mischief in the first degree by knowingly and unlawfully damaging property owned by Kennis Maynard of Inez, Ky with the damages to the property exceeding $1000.

Commonwealth vs. Michelle Horn
The Grand Jury charges that on or before November 5, 2022 in Martin County, Ky the above named defendant:

  1. Michelle Horn committed the offense of fleeing/evading in the first degree by knowingly and unlawfully disregarding signals and commands to stop given by Deputy David Adams with  the Maring County Sheriff’s Department with the intent to flee, avoid or elude his arrest.
  2. Michelle Horn committed the offense of wanton endangerment in the  first degree by knowingly and unlawfully engaging in conduct which creates substantial danger of death or serious physical injury to another person.

Commonwealth vs. Pamela Matthieu
The Grand Jury charges that on or before October 28, 2022 in Martin County, Ky the above named defendant:

  1. Pamela Matthieu committed the offense of trafficking in a controlled substance in the first degree by knowingly and unlawfully being in possession of approximately six oxycodone dosage units and $9,400 in cash monies with the intent to traffic in that controlled substance or by trafficking in that controlled substance, namely Oxycodone.
  2. Pamela Matthieu committed the offense of trafficking in a controlled substance in the second degree by knowingly and unlawfully being in possession of twenty seven and ½ dosage units of Amphetamines and $9,4000 in cash monies with the intent to traffic in that controlled substance or by trafficking in that controlled substance, namely Amphetamines.
  3. Pamela Matthieu committed the offense of public intoxication by knowingly and unlawfully being in a public place manifestly under the influence of a controlled substance, or other intoxication substance to the degree that she was a danger to herself or other persons or property.

Commonwealth vs. Frankie Maynard
The Grand Jury charges that on or before December 4, 2022 in Martin County, Ky the above named defendant:

  1. Frankie Maynard committed the offense of trafficking in a controlled substance in the first degree by knowingly and unlawfully being in possession of more than two grams of Methamphetamine and $174 in cash monies with the intent of trafficking that Methamphetamine or by trafficking in that Methamphetamine.
  2. Frankie Maynard committed the offense of trafficking in a controlled substance in the first by knowingly and unlawfully being in possession of more than ten units of a schedule IV controlled substance and $174 in cash monies with the intent of trafficking that schedule IV controlled substance namely, Gabapentin.

Commonwealth vs. James Harmon
The Grand Jury charges that on or before September 28, 2022 in Martin County, Ky the above named defendant:

  1. James Harmon acting alone or in complicity with Zach Dials and Cody Gullett committed the offense of theft by unlawful taking over $10000 by knowingly or unlawfully taking in excess $10000 in copper transmission wire owned and maintained by AT&T.

The Grand Jury charges that on or before September 28, 2022 in Martin County, Ky the above named defendant:

  1. Cody Gullettacting alone or in complicity with Zach Dials and James Harmon committed the offense of theft by unlawful taking over $10000 by knowingly or unlawfully taking in excess $10000 in copper transmission wire owned and maintained by AT&T.

Commonwealth vs. Zachary Dials 
The Grand Jury charges that on or before September 28, 2022 in Martin County, Ky the above named defendant:

  1. Zachary Dials  acting alone or in complicity with James Harmon and Cody Gullett committed the offense of theft by unlawful taking over $10000 by knowingly or unlawfully taking in excess $10000 in copper transmission wire owned and maintained by AT&T.

Commonwealth vs. Gary Jude 
The Grand Jury charges that on or before November 1, 2022 in Martin County, Ky the above named defendant:

  1. Gary Jude committed the offense of fleeing/evading in the first degree by knowingly and unlawfully disregarding signals and commands to stop given by Deputy Chris Kidd with the Martin County Sheriff’s Department with the intent to flee, avoid or elude his arrest.
  2. Gary Jude committed the offense of operating a motor vehicle while under the influence of alcohol/drugs in the first offense within five years.
  3. Gary Jude committed the offense of wanton endangerment in the first degree by knowingly and unlawfully engaging in conduct which creates substantial danger of death or serious physical injury to another person.
  4. Gary Jude committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of Morphine.

Commonwealth vs. Christopher Jude
The Grand Jury charges that on or before October 25, 2022 in Martin County, Ky the above named defendant:

  1. Christopher Jude committed the offense of fleeing/evading in the first degree by knowingly and unlawfully disregarding signals and commands to stop given by Deputy Chris Kidd with the Martin County Sheriff’s Department with the intent to flee, avoid or elude his arrest.
  2. Christoper Jude committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of Methamphetamine.
  3. Christopher Jude committed the offense of resisting arrest by knowingly, intentionally and unlawfully attempting to prevent Deputy Chris Kidd with the Deputy Chris Kidd with the Martin County Sheriff’s Department from affecting an arrest by using or threatening to use physical force against said deputy.

Commonwealth vs. Johnny Kirk
The Grand Jury charges that on or before November 6,, 2022 in Martin County, Ky the above named defendant:

  1. Johnny Kirk committed the offense of kidnapping (minor) by knowingly and unlawfully restrained another person with the intent to inflict bodily injury or terrorize the minor victim or another, or by depriving the parents or guardian of the custody of the minor, when the person taking the minor is not a person exercising custodial or supervision of the minor.
  2. Johnny Kirk committed the offense of assault in the second degree by intentionally assaulting Misty McKinney of Lovely, Ky causing serious physical injury.
  3. Johnny Kirk, having been charged in the instant indictment with the above stated felony count(s) is now being charged as a persistent felony offender in the second degree.

    The courts are too soft on these repeat offenders and it’s getting ridiculous. I’m 34 years old and have been arrested 3 times myself. 2011 Aggravated DUI (above 0.15), 2015 child neglect (under the influence of drugs/alcohol), and 2020 DUI substance. The neglect charge is from when I was living with my mother. My daughter and her mother had came to stay for the weekend and her mother and myself were under the influence of alcohol, oxycodone, and Valium if I remember correctly. I passed out outside on the porch and her mother was in the bed with her. My mother and one of her friends were sober so I assumed I was ok (the mind of an addict can rationalize anything). My mother called it in as a possible overdose but Between the booze the Valium and being a heavy sleeper I was out. Not sure what she said that brought two carloads of state police but they were there before the ambulance. My last DUI opened my eyes and I’ve been sober over 2 1/2 years. I feel better overall and not chasing all day.
    Back to my point though. The cops do their jobs and then the judges let them off or the District Attorney will cut them a deal. Seems more often than not these guys are beating the cops home. All three of my arrest had me terrified that I was going to pull some time I managed to get by relatively easy with home confinement the last two arrest and the first was a license suspension and later l had to have an interlock device on my car’s ignition and a special instruction on my license that I can only drive cars with interlock devices. These officers need to stand up to these judges and put some of these guys away for awhile. Some of these people need to spend a little time inside to dry out. Addiction is hard to beat. I pass up pain pills all the time. Don’t get me wrong once in awhile I think I would like to have one but then I remind myself what I went through and where I am now, how far I’ve come. Hell, if you don’t think you can get a judge to keep them inside for a little bit then get a 72 hour mental hygiene on them or suggest to the judge and D.A. that they serve atleast 7 days in a detox center before being released back to the community. I understand a lot will overdose after their detox but that’s on them. If a few of them use it as a fresh start and get clean then it’d be a success. These people are just running up the jail bill. If you’re going to run it up anyway then keep them. If not then try to force sobriety on them. Maybe give them all day report if you’re just going to let them leave with a slap on the wrist. I know everywhere has drug problems but we really need something done around here.
