DESTINY DEFENBAUGH, 23, (PHOTO top), & KENNETH DOWNES, 55 , BOTH FROM LOUISVILLE, KY., WERE ARRESTED ON THURSDAY, DECEMBER 21, ON DRUG CHARGES, AFTER A TRAFFIC STOP BY A MAGOFFIN COUNTY, KY DEPUTY FOR SPEEDING WHEN THE DEPUTY DETECTED MARIJUANA SMOKE ODOR COMING FROM THE VEHICLE.
Two Jefferson County, Kentucky residents ended up definitely on Santa’s naughty list, with getting caught with about as much as big lumps of coal you can get in their stockings, after spending Christmas in the grey-steel door hotel jail, after a traffic stop for speeding turned into a drug investigation involving lumps of drugs in their sleigh.
According to the police arrest report, on Thursday, December 21, Magoffin County Sheriff deputy William Tyler Lafferty pulled over in a traffic stop on Destiny Defenbaugh, 23, of Louisville, KY., for driving 77 miles per hour through the “Restaurant Row” area of Magoffin County, which has a speed limit of 45 miles per hour (thus going 32 miles per hour over that set area speed limit).
When deputy Lafferty stepped to the window to talk to her, the deputy detected marijuana smoke, so he began to investigate further. When he asked her if she had anything illegal on her, Defenbaugh allegedly produced two bags of marijuana and a bag of meth.
A bag containing 28 grams of meth and a set of digital scales were also found in a bookbag belonging to her passenger, Kenneth Downes, 55, of Louisville, KY..
Destiny Defenbaugh was arrested by deputy Lafferty and was charged with:
- POSSESSION CONTROLLED SUBSTANCE 1ST DEGREE, 1ST OFFENSE (METHAMPHETAMINE),
- POSSESSION OF MARIJUANA,
- DRUG PARAPHERNALIA – BUY/POSSESS,
- DRUG PARAPHERNALIA – BUY/POSSESS,
- SPEEDING 26 MPH OR > SPEED LIMIT, and
- NO OPERATORS-MOPED LICENSE.
Kenneth Downes was arrested by deputy Lafferty and was charged with:
- TRAFFICKING IN CONTROLLED SUBSTANCE, 1ST DEGREE, 1ST OFFENSE – (> OR = 2 GRAMS METHAMPHETAMINE), and
- DRUG PARAPHERNALIA – BUY/POSSESS.
Both Destiny Defenbaugh and Kenneth Downes remain in the Big Sandy Regional Detention Center in Paintsville, KY., in Johnson County, as of late Friday morning, December 29; and will likely be in the jail well into the New Year of 2024.
