DEFENDANT in Tri State Medical clinic case asking for change in bond release.

LOUISA, Ky. — One of the three defendants indicted in the Tri-State Family Medical Center investigation for charges of Medicaid fraud and forgery of prescriptions was in court last week asking to have the terms of her release to be terminated. Janice Gauze, wife of Kevin Gauze is charged with Complicity Unauthorized Procurement of a Controlled Substance. Mrs. Gauze is represented by Mike Curtis a high profile lawyer from Ashland, Ky. The motion was to terminate the defendant’s drug testing, however, Judge Preston agreed to let her drug test in WV after her lawyer presented his paperwork

Dr. Alfred Baldera, 63, Janice Gauze, 47, and Kevin Gauze, 47, all entered not guilty pleas last month before a Lawrence County judge. Baldera is charged with four Class D felonies including two counts of Medicaid fraud, one count of forgery of a prescription and two counts related to unlawful prescribing of controlled substances. If convicted, he could be facing up to 20 years in prison.

Kevin Gauze also faces up to 20 years, charged with five Class D felonies, including two counts of Medicaid fraud, one count of forgery of a prescription, two counts related to unlawful prescribing controlled substances and one count related to unauthorized procurement of controlled substances.

Janice Gauze faces up to five years for one Class D felony related to unauthorized procurement of controlled substances.

Added to all of the criminal charges, Tri-State Family Medical Center LLC could get up to $20,000 in fines for two counts of Medicaid fraud and one count of forgery of a prescription.

Motion was denied, bond remains the same at $20,000.

Kayla Hunt, 28 was present for a PROBATION VIOLATION FOR FELONY OFFENSE. Case was reset for 12-22-16.

Wayde Leedy, 21 was present for a sentencing hearing on charges of BURGLARY, 1ST DEGREE AND ASSAULT, 1ST DEGREE. Case was reset for 12-22-16.

Christina D. LoweChristina Lowe, 27 was present for a bond hearing on COMPLICITY MANUFACTURE METHAMPHETAMINE, 1ST OFFENSE. Defendant is to be released on home incarceration.

Stephanie Martin, 44 was present for motion hour, motion for a speedy trial. The motion will not be ruled upon until defendant is present and brought before the court.

Douglas Stephens, 36 was in court on charges of COMPLICITY FRAUDULENT USE OF ID CARD OF ELECTRONIC CODE FOR BENEFITS ( 2 COUNTS) AND FAILURE OF NON-OWNER OPERATOR TO MAINTAIN REQUIRED INSURANCE, 1ST, FAILURE TO NOTIFY ADDRESS CHANGE TO DEPT. OF TRANSPORTATION, NO/EXPIRED REGISTRATION, FAILURE TO WEAR SEAT BELTS. All charges were amended to misdemeanors per agreement with the Commonwealth. Defendant has 2 days jail credit.

Kristina Stephens, 38 was present on charges of COMPLICITY FRAUDULENT USE OF ID CARD OF ELECTRONIC CODE FOR BENEFITS (2 COUNTS). All charges were amended to misdemeanors per agreement with the Commonwealth and defendant has 2 days jail credit.

David A. VanceDavid Vance, 42 was present on charges of COMPLICITY CULTIVATION OF MARIJUANA, 5 OR MORE PLANTS, 1ST OFFENSE, 1ST DEGREE POSSESSION OF CONTROLLED SUBSTANCE, UNSPECIFIED,1ST OFFENSE, TAMPERING WITH PHYSICAL EVIDENCE, AND OPERATE MOTOR VEHICLE UNDER THE INFLUENCE OF ALC/DRUGS WITH AGGRAVATOR, 1ST OFFENSE. Per judgement prepared by the Commonwealth based on a guilty plea and offer, driver’s license surrendered to clerk.

Michael Wilks, 40 was present on charges of COMPLICITY CULTIVATION OF MARIJUANA, 5 OR MORE PLANTS, PERSISTENT FELONY OFFENDER, FLEEING OR EVADING POLICE, 2ND DEGREE (ON FOOT) DRUG PARAPHERNALIA AND CRIMINAL TRESPASSING. Defendent pled guilty to a judgement prepared by the Commonwealth.(NOT SPECIFIED IN ORDER)

David Thacker, 44 was present for a status hearing and charges were dismissed without prejudice. Charges not listed on docket.

Amanda Thomas, 34 was present on a status hearing. The defendant was indicted and dismissal was denied. Charges not listed on docket.

Christina Turner, 31 was present on a status hearing. The case was dismissed without prejudice and status was reset for 1-27-17. Charges not listed on docket.

Christopher Borders, 44 was present for a pretrial conference on WANTON ENDANGERMENT, 1ST DEGREE AND TERRORISTIC THREATENING, 3RD DEGREE. Case was reset for 12-9-16.

Amanda Grim, 34 was present for pretrial conference on CONVICTED FELON IN POSSESSION OF A FIREARM, THEFT BY UNLAWFUL TAKING MORE THAN $500.00 LESS THAN $10,000 AND PERSISTENT FELONY OFFENDER. Case was set for rearraignment on 12-9-16.

William Michael Muncy, 42 was present for a pretrial conference on charges of BURGLARY, 3RD DEGREE ( 3 COUNTS) AND FRAUDULENT USE OF ID CARD OF ELECTRONIC CODE FOR BENEFITS (2 COUNTS) 1ST DEGREE POSSESSION OF CONTROLLED SUBSTANCE/COCAINE, 1ST OFFENSE, OPERATING ON SUSPENDED/REVOKED LICENSE AND PERSISTENT FELONY OFFENDER.
