A Martin County Grand Jury returned the following criminal indictments on August 1, 2024.

Commonwealth of Kentucky vs. Martin Gillespie

The Grand Jury charges: That on or before May 2, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Pretrial Conference hearing.

Commonwealth of Kentucky vs. Jonathan Mollett

The Grand Jury charges: That on or before July 18, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Final Report hearing.

Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Pretrial Conference hearing.

The Grand Jury charges: That on or before June 6, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Sentencing hearing.

The Grand Jury charges: That on or before June 6, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Sentencing hearing.

The Grand Jury charges: That on or before March 7, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Change of Plea hearing.

Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Change of Plea hearing.

The Grand Jury charges: That on or before February 15, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Pretrial Conference hearing.

Commonwealth of Kentucky vs. Brianna Ellis

The Grand Jury charges: That on or before February 15, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Johnson County felony charge, he or she failed to appear at that time and place as ordered by the court, namely a Pretrial Conference hearing.

Commonwealth of Kentucky vs. Cody Spears

The Grand Jury charges: That on or before May 22, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Possession of a Firearm by a convicted felon by being in possession of a JP Enterprise Inc brand 12-gauge shotgun and magazine after having been previously convicted of a felony.

Commonwealth of Kentucky vs. Jason Mollett

The Grand Jury charges: That on or before May 5, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Criminal Mischief in the 1st Degree by knowingly and unlawfully destroyed, damaged or defaced property, or tampering with the operation of a key infrastructure asset, namely five strands of telephone /fiber optic cable, a total of 149’9 feet, owned by AT&T telephone company with a value of the cable exceeding $1,000.

2 Defendant, having been charged in the instant indictment with the above stated felony count, is now being charged as a Persistent Felony Offender in the 1st Degree as the Defendant, now more than 21 years of age, was previously convicted of 2 or more felonies.

Commonwealth of Kentucky vs. Michael Baisden

The Grand Jury charges: That on or before May 31, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Wanton Endangerment in the 1st Degree by knowingly and unlawfully engaging in conduct which created a substantial danger to another, namely Mr. James Gilman of Beauty, Kentucky.

2. The above named Defendant committed the offense of Terroristic Threatening in the 3rd Degree by knowingly and unlawfully threatening to commit any crime likely to result in the death or serious physical injury to another person.

Commonwealth of Kentucky vs. Eric Bowens

The Grand Jury charges: That on or before June 20, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Assault in the 3rd Degree by knowingly and unlawfully causing physical injury or attempting to cause physical injury or intentionally causing Emergency Management Service Personnel, namely Thomas Flanery, while Mr. Flanery was acting in his official capacity.

2. The above named Defendant committed the offense of Operating Motor Vehicle Under the Influence of Alcohol or Drugs by knowingly and unlawfully operating a motor vehicle while under the influence of alcohol and/or drugs which impaired his ability to operate said motor vehicle.

3. The above named Defendant committed the offense of Fleeing/Evading 2nd Degree by knowingly disobeying a command to stop by Deputy Justin Bellamy with the Martin County Sheriff’s Department who had reasonable suspicion that the Defendant had committed a crime.

4. The above named Defendant committed the offense of Resisting Arrest by knowingly, intentionally, and unlawfully attempting to prevent Deputy Justin Bellamy with the Martin County Sheriff’s Department from effecting an arrest by using, or threatening to use, physical force against said police officers.

5. The above named defendant committed the violation of Open Alcohol Beverage Container in Motor Vehicle by knowingly and unlawfully had an open alcohol beverage container, namely an open bottle of Everclear in his motor vehicle that was being operated upon a Kentucky Roadway.

Commonwealth of Kentucky vs. Jeffrey Looney

The Grand Jury charges: That on or before June 25, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. The above named Defendant committed the offense of Fleeing/Evading 2nd Degree by knowingly and unlawfully disregarding signals and commands to stop given by Deputies with the Martin County Sheriff’s Department while acting within their official capacity of the office and had reasonable suspicion that the Defendant had committed a crime.

2. The above named Defendant committed the offense of Escape in the 3rd Degree by knowingly and unlawfully escaping from custody of Deputy Justin Bellamy with the Martin County Sheriff’s Department after having been placed under arrest.

3. The above named Defendant committed the offense of Resisting Arrest by knowingly, intentionally, and unlawfully attempting to prevent Deputies from the Martin County Sheriff’s Department from effecting an arrest by using, or threatening to use, physical force against said police officers.

4. The above named Defendant committed the offense of Terroristic Threatening in the 3rd Degree by knowingly and unlawfully threatening to commit any crime likely to result in the death or serious physical injury to another person, namely Deputy Justin Bellamy with the Martin County Sheriff’s Department.

5. The above named defendant committed the violation of Alcohol Intoxication in a Public Place by knowingly and unlawfully appearing in a public place manifestly under the influence of alcohol to the degree that he may endanger himself or other persons or property or unreasonably annoy persons in his vicinity.

Commonwealth of Kentucky vs. Robert Drenning

The Grand Jury charges: That on or before May 11, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Possession of a Firearm by a convicted felon by being in possession of a Winchester brand 12-gauge shotgun and magazine after having been previously convicted of a felony.

2. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

3. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of 2 syringes, scales, and an altered glass pipe.

Commonwealth of Kentucky vs. William Preece

The Grand Jury charges: That on or before May 10, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. William Preece committed the offense of Trafficking Marijuana (More than 8 ounces) by knowingly and unlawfully being in possession of approximately 9.409 ounces (266.732 grams) of Marijuana, with $1,006 dollars in cash monies, with the intent to traffic in that 9.409 ounces in Marijuana or by trafficking in the 9.409 ounces of Marijuana.

2. The above named Defendant committed the offense of Wanton Endangerment in the 1st Degree by knowingly and unlawfully engaging in conduct which created a substantial danger to another, namely Mr. Scottie Thompson.

3. The above named Defendant committed the offense of Operating Motor Vehicle Under the Influence of Alcohol or Drugs by knowingly and unlawfully operating a motor vehicle while under the influence of alcohol and/or drugs which impaired his ability to operate said motor vehicle.

4. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of a Grinder, a plate containing chemical residue and an altered tube containing chemical residue.

5. The above named Defendant committed the offense of Reckless Driving by operating his motor vehicle in a reckless manner without regard for the safety and convenience of pedestrians or other vehicles upon the roadway.

6. The above named Defendant committed the offense of Terroristic Threatening in the 3rd Degree by knowingly and unlawfully threatening to commit any crime likely to result in the death or serious physical injury to another person.

Commonwealth of Kentucky vs. Kenis Bishop

The Grand Jury charges: That on or before June 8, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, namely Methamphetamine.

2. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of a narcotics pipe with burn residue used to ingest controlled substances.

3. Defendant committed the offense of Tampering with Physical Evidence by knowingly and unlawfully concealing physical evidence that he believed would be used against him in an official proceeding.
