WSAZ FIRES REPORTER AMANDA BARREN FOR NOT TAKING VACCINE

Legal expert: Employers have right to require vaccinations and can fire unvaxxed workers

CHARLESTON – The apparent firing of a popular television anchor for allegedly refusing to receive the COVID-19 vaccine has sparked social media discussion about an employer’s right to mandate the vaccine.

WSAZ anchor Amanda Barren has not been seen on newscasts in recent days, and her name has been scrubbed from the station’s website. Neither WSAZ nor Barren have commented publicly about what happened, but multiple sources have said Barren was fired after declining to get the vaccine by the October 1 deadline set by Gray Television, which owns WSAZ.

Barren could not be reached for comment, and WSAZ declined comment on the situation.

Some, including former state Delegate Michael Ihle and the Putnam County Republican Club, also have posted on social media that Barren opted against receiving the vaccine on recommendation of her doctor and said she had antibodies because she already has had COVID.

Others have shared their opinions on the situation on social media, many upset by WSAZ and/or Gray’s decision to fire Barren. Some people on Facebook post comments about Barren on every story WSAZ shares.

Bill Martucci, a partner in Shook Hardy & Bacon’s Washington, D.C., office, is a national expert in business and employment litigation, and he has focused a lot of his efforts in the last 18 months on COVID law.

He said the “really strong” overview right now is mandatory vaccination policies are acceptable under law.

“But in this area, there still is a fair amount of uncertainty,” Martucci told The West Virginia Record. “Still, with key decisions so far and with policies set forth by the Biden administration, there is a great deal of deference given to employers to enforce a vaccination requirement and to dismiss someone if the vaccination requirement is not followed.”

Martucci said specifics of a given case also have to be taken into consideration.

 

“Case law favors the discretion of the employer to have a mandatory vaccination policy and enforcing it, even up to termination,” he said. “The key factor is if there already are special circumstances.

“The two areas that are most prominent there are religious exemption and/or disability exemption. Those two are fairly clear from the guidance of the U.S. Equal Employment Opportunity Commission.”

Martucci said other special circumstances also make the matter more challenging.

“Let’s say there is a medical condition that hasn’t reached a diagnosis yet,” he said. “Is there some duty on the employer to enquire about that, or is there a duty of the employee to bring forth that special consideration?

“So far, it would be the likely responsibility of the individual to come forward to say he or she has concerns because of a certain reason, taking into account the ADA (Americans with Disabilities Act) and common best practices. It would then become an interactive process, and the sides would talk about the details to see if an accommodation can be made.”

    people should stand up for her , risk her life taking the jab is quite stupid for her or any one . if the jab was effective they wouldnt have to push it . you can still catch or spread the covid after the jab and the vaccine is not even formulated for the newest version going around . bless her for standing up to this dictatorship were under

    Sorry for Mrs. Barren. It’s shame people are losing their jobs over this. Makes little sense to lose people over taking a vaccine when we need all the people working we can get espically in the medical field. I had already quit watching wsaz so I am no loss to them but it’s just another reason I am glad I did. I hope Mrs. Barren finds a better higher paying job than the one she lost. Wsaz’s loss in the long run.

        I am very proud to say that I voted for Trump both times. It’s just that she was one of the worst news reporters I have ever seen. Also, employers are well within their legal rights to terminate an employee in the event of this kind of insubordination.

          Had Ms. Barren been hired or had a contract with terms that included the clause with a vaccine that would be required it would had be different, I’m pretty sure she had neither. She was standing up for her constitutional rights, and if more people don’t start doing the same we are soon going to be a full governed country. Much like the communist, is that what you’re looking for there Joe C. I personally think the Washington Government “Biden” with his special orders and bills, are stepping all over our Constitutional rights. We the American People are allowing them to do it every day.
          I personally think Amanda Barren had become a very good reporter working along side Tim and I enjoyed watching them.

    If you don’t want the shot then quit and go to job you don’t need it. It’s the employers right to mandate not the employees. If I want to make $48 an hour I had to get vaccinated, so I got vaccinated.     My favorite anchor at WSAZ. She always seemed like such a good human being, and it showed.
    We all want this pandemic to end, I get it.
    I’ve been vaccinated myself and encourage others to, but the fact that people who have had covid are being forced to vaccinate or lose their job is insane!

    Amanda Barren was one of the Most Professional and Respected News Anchors. This is totally unjust because the Vaccine Mandates are completely Unconstitutional. When you have the Antibodies they protect you just as much as the Vaccine itself. I hope that she can get some Legal Representation and resolve this. Myself and many of my Family and Friends want to see Amanda back on the Air ASAP.

    I met Amanda Barren during the International Festival at Big Sandy Arena a few years ago. She is one of the sweetest and amazing anchors I have ever met in person. She made me feel welcome and hugged me even she does not know me personally. I thought that was a wonderful day for me having to meet her and I will never forget her act of kindness. I am so sorry to hear about her termination. They lost a great person.

    Bye Amanda. You have the right (to for go vaccination) and the workplace has the right to ask for it . Don’t be placing microphones in front of people until you are vaccinated. I won’t be watching WOWK until she is vaccinated.
