IN BIG TIME TROUBLE WITH UNCLE SAM: DALE ALLEN FRALEY, 48, OF LOUISA, IS SCHEDULED TO GO ON TRIAL IN AN ASHLAND, KY. FEDERAL COURT IN MAY FOR CHILD PORNOGRAPHY CHARGES; AND IS ALSO FACING A SECOND TRIAL ON AN OBSCENE MATERIAAL POSSESSION CHARGE FOR HAVING VIDEOS SHOWING ACTS OF BESTIALITY INVOLVING AN ADULT WOMAN HAVING SEX WITH DOGS.

A Lawrence County Ky. man is scheduled to go on trial in federal court in Ashland, Kentucky in May, in connection to a federal child pornography case against him.

A trial date was set for May 10 by U.S. District Judge David L Bunning, after he granted a motion by Dale Allen Fraley’s attorney to sever one of 14 counts for trial purposes.

Dale Allen Fraley, 48, Louisa, was charged in a 13 count indictment in October 2019 with production of visual depictions of a minor engaged in sexually explicit conduct using a means of interstate commerce; receiving visual depictions of a minor engaging in sexually explicit conduct using interstate commerce; distribution of visual depictions of a minor engaging sexually explicit conduct using interstate commerce; anf possession of a matter containing visual depictions of a minor engaged in sexually explicit conduct which had been transported in interstate commerce.

A superseding indictment was returned against Dale Alan Fraley in September 2020, that added a 14th count of production with the intent to distribute obscene matter involving videos depicting bestiality.

Dale Allen Fraley’s attorney, Michael B. Fox of Olive Hill, Kentucky filed a motion last December 2020 to sever the counts, saying the female in the bestiality videos was an adult, and the charge was unrelated to the counts involving child pornography.

“No information has been provided which indicates that the minors were aware of or participated in the conduct described and Count 14,” Michael Fox said in the motion. “Other than the involvement of Fraley, none of the specific facts indicate a relationship between the events that are alleged to have occurred in Counts 1 – 13 and the events described in Count 14. The allegations related to child pornography are wholly distinct from the allegations related to obscene material.”

Michael Fox said the obscene material count “should be severed from the remaining counts for trial.”

“The prejudicial effect the introduction of alleged obscene materials will have on the jury at the trial cannot be understated,” the motion said. “If a jury is presented evidence of alleged obscenities in conjunction with alleged child pornography it will very likely be inflamed and potentially convict Fraley under the child pornography counts simply because he possessed alleged obscene materials. The opposite is also true – the jury is also likely to convict Fraley of the obscenity charge based on the allegations in the child pornography counts.”

The prejudicial effect the introduction of a ledge I’ve seen materials will have on the jury at the trial cannot be understated the motion says if a jury is presented evidence of alleged obscenities in conjunction with alleged child pornography it will very likely be inflamed and potentially convict Fraley under the child pornography counts simply because he possessed a ledge I’m saying materials the opposite is also true the jury is also likely to convict Fraley of the obscenity charges based on the allegations in the chopper Naga for counts.

Judge David Bunning granted the severing motion in January 2021.
