Several Circuit Court cases were final during last week’s hearings as many are sentenced
This month has already produced its second lengthy docket with Judge John Preston presiding. Here is a list of the decisions with sentencing in bold type.
Benjamin Accord, 51 was arraigned on Complicity Trafficking, 1st degree drug unspecified and Complicity Possession of Drug Paraphernalia.
John Allen, 42 was sentenced to 7 years for theft by unlawful taking over $300. He received five years of supervised probation with other conditions.
Larry Bartley, 26 was arraigned was arraigned and given in home incarceration bond on convicted felon in possession of a handgun.
Pre-trial set for 8/23/19
Bradly Boettcher, 33 what sentenced to one (1) year for receiving stolen property $10,000 and 7 days for operating a motor vehicle under the influence of alcohol/drugs. Persistent felony offender, being dismissed.
Scott Boggs, 30 was sentenced to 2 years for possession of a controlled substance, 1st degree, 12 months for carrying a concealed weapon and 12 months for possession of drug paraphernalia. Probated over two years with all of the charges to run concurrent.
Daniel Chapman, 26 was sentenced to 3 for each of 2 counts of, Possession of a controlled substance, 5 days for Operating a MV under the influence of alcohol/ drugs and 12 months on Possession of drug paraphernalia. For a total of 3 years of supervised probation.
Donald Dickerson, 33 was sentenced to 3 years supervised over 3 years (unsupervised) probation for possession of a controlled substance and 12 months for Possession of drug paraphernalia.
Drake Duncan, 21 was arraigned on Possession of a controlled substance, methamphetamine and pretrial set for 8/23/19.
Joshua Fetherolf, was arraigned and pretrial was set for 8/23/19 on Complicity possession of a controlled substance and possession of drug paraphernalia.
Jacob Fields Wright, 20 was sentenced to an amended 2 counts of Theft by unlawful taking of a firearm to 12 months each count for probation and other conditions.
Separate Case: 12 months on amended Theft by unlawful taking and ran the 2 cases concurrently.
Melissa Fyffe, 42 all charges were amended and she was sentenced to 24 months unsupervised probation and other conditions for 2 counts of wanton endangerment.
Claudia Johnson, 35 was arraigned on first-degree possession of a controlled substance. Pre-trial is set for 8/23/19
David Johnson, 42 was arraigned on criminal mischief, resisting arrest and escape 2nd degree. Pre-trial set for 8/23/19
Wallace Kazee, 25 was remanded to custody for not showing up for his PSI on Possession of Methamphetamine.
Travis Lay, 23 did not show for PSI and was remanded to custody on burglary 3rd-degree in persistent felony offender 2nd degree
Jimmy Levering, 60, was sentenced to 3 years unsupervised probation on Complicity Trafficking in a controlled substance and 12 months for Possession of Drug Paraphernalia.
Rhea Mann, 22 pled guilty and will be final sentenced 2 years for Complicity 1st degree Possession of Cocaine and 12 months for Complicity Possession of drug paraphernalia. Final sentencing will be held on 8/23/19
Larry Maynard, 45 was not present and a bench warrant that was issued for trafficking in a controlled substance, possession of drug paraphernalia, no operators license, and failure of owner to maintain required insurance.
Lowell Maynard, 21 pled guilty and will be final sentenced on 8/23/19 to 3 years on complicity possession of a controlled substance, 12 months on complicity to possess drug paraphernalia and 90 days for operating on suspended/revoked operators. All charges ran concurrent probated over three years supervised.
Stella Mullet, 32 a bench warrant was withdrawn and the defendant was sentenced to 3 years for complicity trafficking in a controlled substance, Methamphetamine and 12 months for complicity to possess drug paraphernalia all charges to run concurrent on 3 years of supervised probation with other conditions.
On a separate case: she was sentenced to two years supervised probation and other conditions on complicity receiving stolen property.
Brianna Osborne, 26 Pled guilty and will be final sentenced on 8/23/19 to 2 years for complicity possession of Methamphetamine, 12 months for possession of drug paraphernalia and 12 months for complicity possession of a controlled substance, second degree. The charges to be run concurrent for a total of two years supervised probation with a pre-trial diversion.
Keith Penix, 28 The defendant was not present on a motion to revoke felony probation and a bench warrant issued.
Patrick Robertson, 28 pled guilty and was sentenced to an amended charge of complicity to burglary, 3rd degree. The felony was dropped to a misdemeanor and probation and the defendant received 24 months of supervised probation.
Danny Robertson, 42 pled guilty and was sentenced to an amended charge of complicity to burglary, 3rd degree. The felony was dropped to a misdemeanor and probation and the defendant received 24 months of supervised probation.
Elouise Scott, 36 pled guilty to an amended charge of complicity trafficking in a controlled substance, methamphetamine and received 3 years, the defendant receive 12 months on complicity to possess drug paraphernalia the two charges to run concurrent for two years supervised probation with a diversion.
Frank Spears, 35 pled guilty to complicity trafficking in methamphetamine and was sentenced to 5 years probation and other conditions in agreement.
Separate case: Was sentenced to one year probation consecutive to other case for bail jumping, 1st degree and persistent felony offender was dismissed.
Separate case: and consecutive to one case and concurrent to the other: Defendant was sentenced to 3 years for possession of a controlled substance, methamphetamine and 12 months probated over three years probation.
Prince Stevens, 27, was arraigned on bail jumping, 1st degree and pre-trial set for 8/23/19
I think we need new judges. No wonder drugs are taking over the area, dealers and users aren’t afraid of the law. Why should the law enforcement officers risk their lives to catch them. Looks like everyone should follow that that girl at Blaine’s lead.
So totally agree. If some if these repeat offenders would actually have to serve time maybe they would learn. They just get their hands smacked and do the same thing over and over. If there isn’t enough jails to hold them, then build more. This is crazy.
Need new justice system!
Just give these people probation so that can keep catching charges.
