BOWEN SENTENCED TO 10 YEARS AFTER BEING ENHANCED BY A PERSISTENT FELONY OFFENDER CHARGE

Lawrence County Circuit Court was held on Friday, Feb. 22nd. with Judge J. D. Preston presiding. he heard cases from 1st degree Rape to Stalking. Graduated Sanctions are replacing Probation Revocations in Preston’s court. A graduated sanction is a step before the court sends defendants on probation to prison. The punishment varies depending on the probation violation, the defendant’s past, etc.

Richard Bowen, 29 was sentenced to 5 years for Burglary, 3rd degree enhanced with the Persistent Felony Offender to 10 years, suspended after 1 year with the remainder to be on supervised probation for 5 years with other conditions.

 

 

 

 

 

Matthew Caudill, 37 sentenced to 8 years to serve for Engaging in Organized Crime/ Criminal Syndicate.

 

 

 

 

 

 

 

Rebecca Clark, 41 pled guilty to Complicity Receiving Stolen Property/ under 10,000 and will be final sentenced on 3/22/19 to 2 years supervised probation with other conditions.

 

 

 

 

 

 

 

Teresa Clay, 51 was sentenced to a graduated sanction on a Probation Revocation hearing. Graduated sanctions can be anything from adding time to a sentence to home confinement. It is the step before revoking probation completely.

 

 

 

 

 

Tiara Curry, 23 pled guilty to 1st degree Possession of a Controlled Substance (unspecified) sentenced to 3 years with a diversion and other conditions. Misdemeanors all dismissed.

 

Final sentencing scheduled for 3-22-19.

 

 

 

 

 

Mark Mollett, 43 was sentenced to 1 year for Possession of Methamphetamine, 1 year for Complicity Conspiracy to Trafficking in Controlled Substance, 2nd degree and 30 days for Possession of Marijuana. All charges to run concurrent and supervised probation with a diversion over 3 years.

 

 

 

 

 

Robert Parker, 35 pled guilty to Convicted Felon in Possession of a Firearm concurrent to 18-CR-27 (next case) but consecutive to felony.

 

Seperate Case:

The defendant pled guilty to an amended charge of Complicity Trafficking in a Controlled Substance, methamphetamine and will receive 5 years concurrent to the first case and consecutive to felony. Persistent Felony Offender was dismissed along with Complicity Drug Paraphernalia.

 

 

 

Jamie Shritters, 64 was present for a Probation Revocation Hearing and was sentenced to a graduated sanction.

 

 

 

 

 

 

 

William Spencer, 25 was sentenced to 3 years supervised probation with a diversion over 5 years and other conditions on Stalking, 1st degree.

 

 

 

 

 

 

 

James Cook, 34 was sentenced to a graduated sanction on a Probation Revocation Hearing.

 

 

Pre-trial, Arraignments and all other cases:

 

 

 

 

 

Roger Vincent, 21 was remanded to custody for not showing up to complete his PSI. Case reset for next month on charges Complicity Robbery, 2nd degree, Complicity Trafficking in a Controlled Substance, 1st degree, methamphetamine, Complicity Assault 4th degree Minor Injury, Complicity Drug Paraphernalia and Complicity Traffic in Marijuana.

 

 

 

 

Robert Chafin, 42 Has an outstanding bench warrant for 2 cases

 

1st case: 1st degree Possession of Cocaine, 1st offense, 1st degree Possession of Cocaine, 1st Cocaine.

 

2nd case: Bail-jumping, 1st degree

 

 

 

Jason Hale, 39 was rescheduled for a hearing on 3/8/19 on 2 cases.

 

Complicity Trafficking in a Controlled Substance, 1st offense drug unspecified and Complicity Trafficking in a Controlled Substance, 3rd degree, 1st offense.

 

2nd case: Bailjumping, 1st degree also set for 3/8/19.

 

 

 

James Isaac, 56 is scheduled for a trial date after turning down plea agreement. Defendant to report on May 15, 2019 and trial date set for 5/15/19 on Operating MV under the Influence of Alc/Drugs, 4th or greater offense, Operating On Suspended/Revoked License with Operating ATV on Roadway and Possession Open Container in a MV being dismissed.

 

 

 

 

William Litton, 49 was scheduled for sentencing on Rape, 1st degree and case was reset for next motion hour. Docket does not reflect date.

 

 

 

 

 

 

 

Aaron Maynard, 25 was arraigned for Trafficking in a Controlled Substance, 1st offense, methamphetamine and Possession of Drug Paraphernalia.

 

Pretrial set for 3/22/19

 

 

 

 

 

William McCoy, 47 a motion was granted for the defendant to relocate and work outside of the Commonwealth.

 

 

 

 

 

 

 

 

Stella Mullett, 31 was arraigned on Complicity Receiving Stolen Property.

 

Pretrial set for 2-22-19.

 

 

 

 

 

 

 

Green Ramey, 39 was present for a Probation Revocation Hearing on 2 cases.

 

Case was reset for date of pretrial on new case.

 

 

 

 

 

 

 

Prince Stevens, 27 was present on Engaging in Organized Crime, Crimimal Syndicate.

 

Sentencing scheduled for 3/22/19.
