BALLOU WILL GO TO TRIAL IN AUGUST OVER KILLING SON, REJECTS PLEA DEAL

Caudill sentenced to 5 years on five separate cases; Harless charged with burglary  

Alleged murderer Nicholas Ballou was present in Circuit Court on Friday, April 13th. The defendant has not yet taken the Commonwealth’s plea deal and will now go to trial for the murder of his then five-year-old son Landyn. The incident, which took place in August 2011, will possibly have some closure in 2018 with the new trial.

The docket (from the office of Circuit Clerk Jodi Webb Parsley) included:

 

Nicholas C BallouNicholas Ballou, 31 was present on another Pretrial conference.

A trial date has been set for Ballou to face the charge of murder for August, 27 2018.

Ballou, the victim’s father who is currently serving time for the horrific injuries that he inflicted upon his then two month old son in August of 2011 was indicted for murder.

The child suffered from cerebral palsy, permanent brain damage and was legally blind after the abuse from his own father. Ballou took an Alford Plea, accepting no responsibility for the child’s injuries that included multiple skull fractures and brain injuries.

Ballou, who went on the run from police for an extended time before being caught in Morgan Co. told his now ex-wife Amy that the baby had choked on his baby bottle. However, the child suffered major head trauma that left him legally blind and with permanent brain damage with three skull fractures.

Landyn has since died from the injuries and the Commonwealth is now charging Mr. Ballou with murder.

 

 

 

 

 

 

 

Carl P. BarnesCarl Barnes, 56 was arraigned on Theft of Services and is set for pretrial on 5/11/18.

 

 

 

 

 

 

 

 

Brandon L. BurchettBrandon Burchett, 27 was sentenced to 2 years, supervised probation with a diversion over 4 years and other conditions on 1st Degree Possession of Cocaine.

 

 

 

 

 

 

 

Matthew R. Caudill Matthew Caudill, 36 was sentenced (on 5 separate cases) to: 

* 5 years for Bailjumping, 1st Degree,

* 5 years for Complicity 1st Degree Possession of a Controlled Substance, Cocaine,

* 60 days for Complicity Possession of Drug Paraphernalia,

* 3 years for 1st Degree Possession of a Controlled Substance, Cocaine and

* 60 days again for Drug Paraphernalia,

* 3 years Possession of a Controlled Substance,

* 3 years for Possession of a Controlled Substance and

* 30 days for each misdemeanor.

All of the cases were run concurrent and the defendant was sentenced to five years overall.

 

 

 

 

 

Sierra D. Caudill Sierra Caudill, 33 was sentenced to 3 years supervised probation over 5 years with other conditions on Criminal Possession of a Forged Instrument, 3 years for Theft By Deception.

All charges to run concurrent with other conditions.

 

 

 

 

 

William W. ChafinWilliam Chafin, 31 was present on the charge of Fraudulent Use Of ID Card Of Electronic Code For Benefits.

Hearing set for next month on 4/27/18.

 

 

 

 

 

 

 

Steven ComptonSteven Compton, 25 was arraigned on 2nd Degree Assault, Operating A Motor Vehicle Under The Influence Of Alcohol/Drugs And Failure To Wear Seatbelts.

Pre-trial set for 5/11/18.

 

 

 

 

 

 

Jeffrey M. CopleyJeffery Copley, 46 was set to enter a plea on Complicity Trafficking In A Controlled Substance, Methamphetamine, Complicity Possession Of Marijuana.

No plea was entered and a date was set for 4/27/18 for next court appearance.

 

 

 

 

 

Dustin L. FyffeDustin Fyffe, 29 was arraigned on charges of Fleeing Or Evading Police, 1st Degree, Operating A Motor Vehicle Under The Influence Of Alcohol/Drugs, Operating On Suspended/Revoked Operators License, Failure To Wear Seatbelts, No/Expired Kentucky Registration Receipt, No Registration Plates, Failure To Register Transfer of Motor Vehicle and Failure of Owner To Maintain Required Insurance.

Pre-trial is set for 5/11/18

 

 

 

 

 

Justin W. HarlessJustin Harless, 30 was arraigned on 2 counts of Burglary, 3rd Degree and Persistent Felony Offender.

Pre-trial set for 5/11/18.

On a separate case, defendant was arraigned on Complicity Burglary, 3rd degree and Complicity Theft By Unlawful Taking or Pocket Picking and Persistent Felony Offender.

Same Pretrial date.

 

 

 

 

 

Amanda JordanAmanda Jordan, 37 was present on a Motion For Discovery And Inspection On The Charge Of Complicity Manufacturing Methamphetamine, 1st offense.

Motion was granted.

 

 

 

 

 

 

Cole Frederick MayCole May, 35 was present on a status hearing for termination of drug court.

Date for defendant is reset but the docket does not reflect the day the case will be heard.

 

 

 

 

 

 

 

Lowell Justin MaynardLowell Maynard, 31 was sentenced to 1 year, concurrent with another case for Complicity Trafficking In A Controlled Substance, 2nd Degree.

 

 

 

 

 

 

 

 

Chastity L. NicholsChastity Nichols, (no age provided) was sentenced to 5 years supervised probation with a diversion and other conditions on each of 3 counts of Theft By Unlawful Taking $500 or more, all concurrent.

 

 

 

 

 

 

 

Kevin L. PackKevin Pack, (no age provided) was arraigned on Tampering With Physical Evidence, Public Intoxication and Carrying A Concealed Deadly Weapon.

Pre-trial date set for 5/11/18.

 

 

 

 

 

 

Lacy Lee PackLacy Pack, (no age provided) was arraigned on Receiving Stolen Property U/$10,000, Fleeing or Evading Police, 1st Degree and Operating a Motor Vehicle Under the Influence of Alcohol/Drugs.

Bond set for ROR/ MCR drug testing.

Pre-trial set for 5/11/18.

 

 

 

 

 

 

Bradley E. ParsleyBradley Parsley, 40 was arraigned on Tampering With Physical Evidence, Wanton Endangerment, 1st Degree And Possession Of A Controlled Substance, 1st Degree, Second Or Greater Offense.

Pre-trial set for 5/11/18.

 

 

 

 

 

 

Charles D. Perkins Charles Perkins, (No age given) arraigned on Possession of a Controlled Substance, 1st Degree and Possession of Drug Paraphernalia.

Pre-trial date set for 5/11/18.

On a separate case: A hearing is set for 4/27/18 on the charges of 2 counts of Engaging In Organized Crime/Criminal Syndicate.

Final sentencing to be held on 5/11/18.

 

 

 

 

 

Hansel WileyHansel Wiley, 48 defendant not present and a bench warrant issued for Criminal Possession Of A Forged Instrument.

 

 

 

 

 

 

 

 

David B. Johnson David B. Johnson, 41 was present for a change of plea but the docket does not reflect any change on charges of Criminal Mischief, Attempt Escape, Resisting Arrest, Wanton Endangerment and Persistent Felony Offender.

On a separate case the defendant is charged with Assault, 3rd Degree, Disorderly Conduct, Falsely Reporting An Incident And Persistent Felony Offender.
