SODOMY, MURDER, DRUGS ON DOCKET THIS WEEK

Lawrence County Circuit Court Judge John David Preston saw and sentenced several high profile cases on Friday, February 9th.

The Tri State Family Medical Center, LLC was exonerated of liability and all charges were dropped against the medical center, however owners Kevin and Janice Gauze both entered guilty pleas based on the Commonwealth Attorney’s offers. Elden Muncy, Jr., 22, was arraigned on 2 counts of Murder and Steven Prater was present facing 20 plus counts of Sexual abuse crimes.

Tonielle AdkinsTonielle Adkins, 27 was sentenced to time served and continued Substance Abuse program on (amended charge of) Trafficking In A Controlled Substance and Promoting Contraband and on a separate case the defendant was sentenced to 10 years of probation, 5 unsupervised along with other conditions.

 

 

 

 

 

DR. ALFRED BALDERA Alfred Baldera, 65 had a Motion for an Expungement granted

 

 

 

 

 

 

 

 

Gary BrewerGary Donald Brewer, 68 was sentenced to an amended charge of Theft By Unlawful Taking over $10,000 and received 4 years consecutive to the time presently serving on a Martin County case.

 

 

 

 

 

 

 

 

 

Jackie Brooks, Jr.Jackie Brooks Jr., 31 was present on a Motion For A Diversion Completion and the motion was denied on the grounds of ineligibility

 

 

 

 

 

 

 

 

 

 

Jesse F. CaudillJesse Caudill, 33 was arraigned on Persistent Felony Offender, 1st Degree, Criminal Possession Of A Forged Instrument 2nd Degree, Theft By Deception Including Cold Checks. In home Incarceration given for bond along with MCR and drug testing. A public defender was appointed.

 

 

 

 

William W. ChafinWilliam Chaffin, 29 pled guilty and was sentenced to probation with 5 out of 3 years supervised and In house rehabilitation for Fraudulent Use Of ID CARD OF ELECTRONIC CODE FOR BENEFITS.

Scheduled to be final sentenced on 3/9/18.

 

 

 

 

3. Danny D. ColegroveDanny Colegrove, 31 pled guilty and was sentenced to three years for Theft By Unlawful Taking, 12 months unsupervised probation on Possession Of Drug Paraphernalia and the sentence enhanced to 10 years for Persistent Felony Offender, 1st degree, all concurrent.

 

 

 

 

James CookJames Cook, 33 was present on a Probation Violation Hearing, the defendant stipulates to violations, order to be sent.

 

 

 

 

 

 

 

Joshua Q. CyrusJoshua Cyrus, 43 was present for a bond violation hearing on Complicity To Manufacture Methamphetamine, 1st Offense And Complicity Receiving Stolen Property (Firearm), case reset for 2/23/18

Freda DavisFreda Davis, 36 was sentenced to 3 years Supervised Probation over 5 years and 180 days of Home incarceration, 3 years for Tampering With Physical Evidence, 12 Months For Possession Of A Controlled Substance, 12 Months For Possession Of Drug Paraphernalia, 12 Months For Theft By Unlawful Taking And 45 Days For Possession Of Marijuana, All Concurrent.

 

 

 

 

 

Janice GauzeJanice Gauze, 47 pled guilty and was sentenced to 3 years and a diversion (with other conditions) on Complicity Unauthorized Procurement Of A Controlled Substance and on a separate case the defendant received 3 years diverted after 3 years on Complicity To Present Fraudulent Claims To Defraud KMAP

 

 

 

 

 

Dr. Kevin GauzeKevin Gauze, 48 changed his plea to guilty and accepted the Commonwealth’s offer (not reflected on the docket) See story on Lazer main page which includes AG’s recommended sentence.

The defendant is scheduled to be final sentenced in March (no exact date given on docket)

 

 

 

 

 

April Ann HarperApril Harper, 33 pled guilty and was sentenced to 5 years with a diversion for ; both to run concurrent. On a separate case the defendant received 3 years supervised over 5 years (with a diversion) on Fraudulent Use Of An ID Card Of Electronic Code For Benefits, 2 Years For Possession Of A Controlled Substance, 1st Offense And 90 Days For Theft By Unlawful Taking/Shoplifting, all charges to run concurrent

 

 

 

 

 

Kayla J. Horn HuntKayla Hunt, 29 pled guilty to and amended charge of Complicity To First-Degree Burglary, Amended To Facilitation And Sentenced To 5 Years Of Supervised Probation And Convicted Felon In Possession Of A Handgun Was Dismissed, charges to run consecutive to another case

 

 

 

 

 

Richard A. LaneyRichard Laney, 57 was sentenced to 3 years of supervised probation with 120 days to serve on Operating DUI –  Alcohol/Drugs, 4th Offense, 90 Days For Operating On Suspended/Revoked Operators License And Failure To Wear Your Seat-Belts or to Surrender Revoked Operators License was dismissed.

 

 

 

 

 

Candy N. MayCandy May, 25 was not present on a Motion to Void Pretrial Diversion and a bench warrant was issued

 

 

 

 

 

 

 

 

 Lowell Justin MaynardLowell Justin Maynard, 30 was sentenced to 3 years for Possession of a Controlled Substance, 1st degree (methamphetamine) 12 months on Possession of Drug Paraphernalia, 12 months for Theft By Deception and 12 months for Possession of a Controlled Substance, 2nd degree. The defendant’s Pretrial diversion was set aside and the defendant was remanded to custody

 

 

 

 

 

Jessica McKinneyJessica McKinney, 36 was on the docket for 1st degree Possession of Cocaine and Possession of Drug Paraphernalia. The defendant was incarcerated in a different county and the case was set aside until 2/23/18

Joel D. StevensJoel Stevens, 60 was sentenced to 3 years on Driving DUI Suspended License, 3rd offense, 12 months for Operating a Motor Vehicle Under the Influence of Alcohol, 3rd offense, 90 days for Failure To Maintain Required Insurance, all concurrent.

 

On a separate case the defendant was sentenced to 3 years with other conditions on Operating A Motor Vehicle Under The Influence Of Alcohol, 4th Offense, 30 Days For Operating On Suspended License And Persistent Felony Offender was dismissed, all concurrent. Defendant is incarcerated.

 

 

 

 

 

Tri State Family Medical Center, LLC, an order was agreed upon to dismiss all charges including 2 counts of Complicity Present Fraudulent Claims to Defraud KMAP and Complicity Forgery of a Prescription, 1st offense.

Case #1 sentenced to 3 years on Complicity Trafficking in a Controlled Substance, methamphetamine.

Case #2 sentenced to 15 years on Complicity to Manufacture Methamphetamine, 3 years for Complicity Trafficking in a Controlled Substance and 12 months for Complicity Possession of Drug Paraphernalia.

Case #3 sentenced to 1 year for Bail jumping.

Case #4 sentenced to 2 years for Possession of a Controlled Substance, 1st degree, 12 months for Tampering with Physical evidence, 12 months for Possession of a Controlled Substance, 3rd degree and 12 months for Possession of Drug Paraphernalia. All cases to run concurrent.

 

 

 

 

Roger Barnes, Jr. Roger Barnes Jr., 32 was scheduled for a pretrial conference on 3 counts of Complicity Receiving Stolen Property, Complicity Possession Of A Controlled Substance, 1st Degree (Methamphetamine) And Complicity Possession Of Drug Paraphernalia.

The defendant was not present and a bench warrant to be issued
