A Johnson County grand jury on Wednesday, August 17, has returned eleven (11) indictments against ten (10) individuals, including that of a case of a Paintsville, KY. man following a January 15, 2022 incident in which he allegedly climbed through a family’s window and raped a teenage girl.

According to jail records, Gary Phillip Robertson, 42, of Paintsville, Ky., was originally arrested on January 15, 2022; and booked into the Big Sandy Regional Detention Center on a charge of second-degree burglary. The arrest citation said that Gary Robertson was caught crawling in the window of the teenage girl by her father, but includes no more detail than that.
The indictment said Gary Robertson “committed the offense of burglary in the second degree by knowingly and unlawfully entering into and remaining in a dwelling house located (on Bridge Street) in Paintsville, to commit the crime of rape.” According to the indictment, Gary Robertson was alleged to have committed rape by “knowingly and unlawfully being 41 years of age and engaging in sexual intercouse with a 17 year old, at the time of the intercourse.”
According to BSRDC and court records, Gary Robertson posted a $5,000 surety bond for his release on January 16, with conditions of no further violations of law, no contact with the alleged victim or complaining witness, no contact with the location of the alleged appearance and was required to make all scheduled court appearances.
Gary Phillip Robertson has since been arrested in Lawrence County on late Thursday night, August 25, by deputy Joseph Robertson, and was transported to and is lodged currently in the Big Sandy Regional Detention Center. Gary Robertson has a court date set for October 17 in Johnson County Circuit Court.
The two criminal charges that Gary Phillip Robertsoni is facing, second-degree burglary is a class C felony with a potential penalty of five to 10 years in prison and a fine of no more than $10,000 and third-degree rape is a class D felony that carries a penalty of one to five years in prison and a fine of no more than $10,000.
The remaining following were also indicted this month in Johnson County:
Jesse L. Ward, 44, of Nippa, KY., was indicted on a charge of third-degree burglary (complicity), a class D felony with a potential penalty of one to five years in prison and a fine of no more than $10,000.
Nequa N. Brown, 28, of Van Lear, KY., was indicted on charges of third-degree burglary (complicity), a class D felony with a potential penalty of one to five years in prison; and a second indictment of second-degree trafficking in a controlled substance (less than 20 dosage units of a schedule III substance), a class A misdemeanor that carries a penalty of no more than 12 months in jail and a fine of no more than $500.
Nequa Brown was arrested on Thursday evening, August 18, by the Johnson County Sheriff Office on the indictment charges.

Cameron Mollette, 21, of Nippa, KY., was indicted on a charge of third-degree burglary (complicity), a class D felony with a potential penalty of one to five years in prison and a fine of no more than $10,000.
Jesse Ward, Nequa Brown and Cameron Mollette were indicted in complicity with one another on the burglary charge.
Darren S. Mollette, 29, of Boons Camp, KY., was indicted on a charge of first-degree possession of a controlled substance (methamphetamine), a class D felony with a potential penalty of one to five years in prison.
Darrene Mollette was arrested on Thursday evening, August 18, by deputy Owens of the Johnson County Sheriff Office on the indictment charge.
David Neal Chandler, 41, of Paintsville, KY., was indicted on a charge of first-degree possession of a controlled substance (methamphetamine, complicity), a class D felony with a potential penalty of one to five years in prison.
Jonathan C. Owens, 34, of Salyersville, KY., was indicted on a charge of first-degree possession of a controlled substance (methamphetamine, complicity), a class D felony with a potential penalty of one to five years in prison.
Breanna Marie Strickland, 21, of Paintsville, KY., was indicted on a charge of first-degree possession of a controlled substance (methamphetamine, complicity), a class D felony with a potential penalty of one to five years in prison.
David Chandler, Jonathan Owens and Breanna Strickland were indicted in complicity with one another.
Rex D. Vicars, 55, of Thelma, KY., was indicted on a charge of first-degree promoting contraband, a class D felony with a potential penalty of one to five years in prison.
Joshua Lee Kirk, 41, of Inez, KY., was indicted on charges of first-degree possession of a controlled substance (methamphetamine), a class D felony with a potential penalty of one to five years in prison, third-degree possession of an unspecified controlled substance, a class A misdemeanor that carries a penalty of no more than 12 months in jail and a fine of no more than $500, possession of marijuana, a class B misdemeanor that carries a penalty of no more than 90 days in jail and a fine of no more than $250 and possession of drug paraphernalia, a class A misdemeanor that carries a penalty of no more than 12 months in jail and a fine of no more than $500.
The Johnson County grand jury did not return any no true bills.
